I have just checked on my judgement staus online at Moneyclaim and it has been rejected...REJECTED? I won???? Barclays took me to the 28day wait, I waited and entered a Judgement request..and its rejected..Now What??? £2200 of charges!!!! No one will be on here now I assume. Will check tomorrow to see if anyone has any great ideas on what I do now! Start again for another £120???

It could mean that Barclays have entered their defence at the last minute and that you cannot continue online so no, you dont start again :) You can always ring MCOL to check what is going on but this is the most likely scenario.

You will receive a copy of their defence and perhaps an Allocation Questionnaire to complete and return with the fee of £100 as your claim is over £1,500. Some judges are dispensing with the AQ because the banks dont turn up at court so you may be lucky there and not have to do this. From then you will get a hearing date. Timing for this is variable dependant on how busy the court is but they wont turn up.

This post shows what happened when one woman on this site went to court against Barclays and its really reassuring about it all. Top thanks to OP showmethemoney! for her post:

Relax and take things as they come now and deal with it methodically and calmly. Its only a matter of time before you get your money back. Good luck :)

Basically yes and relax. It unlikely you will end up in a court room have a read of what happens if you do here, this case was against Barclays and is very reassuring about the process. Top thanks to OP showmethemoney! for her post:

If you dont fancy the court route you can always use the Financial Ombudsman if you dont get any satisfaction but you will have to exhaust the banks complaint procedure first and suffer the 8 week delays to reply to your letters :(

The odds of getting your money back are in your favour so try not to worry and good luck :)

Hi, am brand new to this reclaiming business so would really appreciate a bit more info. I have many MANY charges incurred over the last 6 years from HSBC, but I am now living overseas. My sister in England is gonna help me, but i'm worried it will all be a lot trickier as I am not in UK.
    Couple of questions -
Do you need to apply seperately to reclaim credit card charges (same bank, linked to my current acocunt)?
Is an offshore account (with Lloyd's) sufficient for a parachute account? If not, can anyone recommend a good online bank (need to set-up and access from Middle East)?

    Thanks!

You can simply use your sisters address to receive the mail and write the letters signing on your behalf. The bank will normally just require some identification from you both and written authorisation from you for her to act on your behalf. Once that bits done the rest is straightforward.

You can view your 6 years details online with HSBC online banking so that makes it a bit easier too. An offshore account with Lloyds is as good an account as any and it is really only in case HSBC close your account. They may not do this.

The process is laid out in steps and most claims follow this process pretty smoothly more or less. The forum is here to help with any difficulty you may run into, somebody somewhere will have been through it and can offer advice, so go for it and good luck :)

Edit: Adding some stats from the first 98 pages of the Success Thread for a bit of extra reassurance:

HSBC - 115 cases of which:

72 cases settled for less than the amount claimed but for not much less than claimed, presumably without interest
32 cases were settled in full without the need for court and some after the first letter only
7 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court

    Of 4 court cases noted:

2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days
1 settled in full after court claim filed
1 settled for less after court claim filed and it was accepted by the claimant

    :)

That's great, thanks. So along with the first letter I send (signed by my sister with note underneath saying On Behalf Of Me), I need to send a letter from me saying that she will be signing on my behalf.
They blocked access to my online banking account cos I tried to access it overseas (surely this is one of the benefits of online banking???? Thanks HSBC you morons!), and despite requesting 4 times for them to send me the 'security pack' so i can re-register, they haven't!
Have many people had success with claiming from HSBC? I see a lot of feedback about other banks...

I have a claim against Lloyds fo £1220 which includes int and court charge. They entered a defence yesterday. What will happen next. I feel i'm going to be taken to court and i'll be the only one to lose??
  • Can someone please advise. I issued warrant of execution
    when there was no
response to Judgment by Default against Barclays. They have sent a letter
that i should agree to payment of the sum paid by them in full and final settlement of my claim. Also there be a voluntary Stay of Execution pending payment. That upon receiving payment I write to the Court stating that I have
withdrawn my claim pursuant to a settlement between the Parties. Finally that I consent to the default Judgment being set aside:They have enclosed draft Consent Order for me to sign and set aside the Default judgment, which they say they will arrange for it to be filed at Court after my account has been credited. Barclays say once they have received these documents from me they will arrange for the funds to be recredited to my account.

I don't want to put a step wrong now as it is the Bank's litigation team dealing with the matter.I don't know if I should sign and don't understand
"There be a voluntary Stay of Execution pending payment"

    Any advice gratefully received.
