Hi Titch i'm having problems with the Ulster bank as well, I sent of for my default charges on the 26/02/07 and as yet I have not received any correspondence from them at all. I then sent another letter on the 20/04/07 giving them 7 days to send out my default charges or i would send copies of my requests to the Information Commissioner.
This is who i'm taking on

Hi Ya I too am claiming of the Ulster Bank. I sent the letter out on the 16 April and havent recieved any response or acknowledgement from them. They have 6 days left to reply or else it will go to court. They seem to not want to know!!!Winnings 2009: Rimmel Pro Lycra Nail Polish.

I have posted before about my bank, but I was looking to ask someone about my current mortgage. I have had thisa mortgage for just over 3 years but so far I have accumulated alot of fees. Could someone tell me if I am able to claim these back or should I just leave them alone as it is my home im dealing with. Thanks. I am currently trying to claim £1166 from The Royal Bank of Scotland and after sending the first letter I received a reply stating that they would look into this and get back to me. I waited a while (nothing happened) then sent the next letter threatening court action if nothing happened within 14 days. The deadline for this is tomorrow and im wondering what my next step should be? Is it possible and indeed worth ringing the bank and asking what the latest is on my claim? (if so, do I ring my local branch?) or should I proceed to the next step as on this website?

It is worth a try to ring and see if they will settle out of court. Be sure to get any offer of settlement in writing though and check carefully the terms of accepting their offer, there will almost certainly be conditions. The most common of which is not to reclaim in future/accept that future charges will stand. Good luck0 -
After sending all the various letters to Nat West, they told us they were preparing an offer letter. This was some 4 weeks ago. We thought we'd give them a little while to send it, but when we rang them today, they said we would have to wait a further 3 weeks - good god, what planet are they on they on. How can it take 7 weeks to write a letter. Fed up now so filed claim. Not sure what happens now, but will wait and see and let you know.
On a more positive note, had offer letter from Marbles which we accepted. Does anyone know how long it takes to get into your account?0 -

I have a few questions if anyone can help please. I don't want to waste time if any of this is not possible.
I went bankrupt in January this year. What pushed me over the edge was 12 months of interest, late paypent and overlimit fees from my bank, credit cards, loans etc.
Without these charges I could have made headway through my debt.
1. Can I reclaim these charges as I am now bankrupt?
2. Would the OR get the money? I would not mind as it would go towards my
debts, but is it relevant to my assests (I have none) as this was before
bankrupcy?
I just feel that after reading these posts, that my bankrupcy was forced upon me mainly due to these charges. Also in no way am I sherking any responsibility of becoming bankrupt either!!!
Any advice would be greatly appreciated

Thought I would let everyone know what Nationwide have done. My son has been claiming his charges back from NW although I have been doing all the correspondence and he has signed all the letters. He is claiming back charges on two accounts. We stated the account numbers clearly on all correspondence. We started the court process on 23rd March and when I was setting this up with MCOL I put my name down for correspondence to be sent to. The 28 days is up tomorrow and today I received a letter from NW, addressed to me, informing me that they had refunded £155.95 in charges, credited £120 to cover costs and a further £64.53 representing interest charged dating back 6 years. To begin with I thought that this was a part payment on my son's account, but imagine my surprise (and a little bit of glee!) when I realised that this had been refunded to my personal account, and that the charges schedule they had enclosed referred to my personal account. I didn't even claim back any charges from them for myself!! Anyway, I checked my account and there was a "Correction" creddited to my account for £155.95 but the other two amounts were not there? Do you think I could be cheeky enough to ring them up and ask where these are?
On the downside, when iI checked MCOL I found that they had put in a defence for the full amount for my son's charges (the day before the default date) and we now have to wait to hear about a court hearing. Has anyone idea what might happen next?They call me Mr Pig!0 -
Please see below - is this ok and sufficient for the MCOL particulars (date is 20/03/01 as charges on this date included in original letter to HSBC in march)
"The Claimant has an account ******* with the Defendant.Since 20/03/2001 the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied.
Claimant contends:The charges exceed the Defendant's losses caused by the breaches;The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999,Unfair Contract Terms Act 1977 and at Common Law.
Claimant claims: return of the amounts debited of £1700; The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 20/03/2001 to 24/04/2007 of £500 and also interest at the same
rate up to the date of judgment or earlier payment at a daily rate of 0.22.If the charges are a fee for a service,then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982.Costs allowed by the Court."

Are you sure your interest sum is correct? It's an amazingly round sum. Also, your daily rate should read 0.286 (1,300 x .00022).Reclaimed thanks to this site:
