  • Hi,

I am new to this site and not very good with finding my way around websites lol.

I am writting to get advice about a bank account that was open with hsbc since 1997 the account was used in a good way received no charges at all untill two years when my partner worked out that she could use her Switch Card in shops etc without the availabkle funds being in the account when the card was being used, The account has now been closed and debt collection agency has finally found her after her trying to avoid paying as she only just has a baby and didnt need the stress of having to deal with people trying to grab money from her after having a baby.

I am guessing that most of the charges would be card misuse fees, And most likely interest and monthly bank charges.

Could anyone please HELP with the mess my partner has got her self into, with regards to what she can claim back, she currently owes £2619

Thankyou for reading this and i hope that i havent caused to much fuss and thankyou for the feedbacks in advance
    Thanks

    Simon

She can claim back her charges but its likely any monies refunded will be put towards the debt account. Have a read of this thread...

Just a bit of a rant really.

Not wanting to be a drama queen but listened to the podcast of Tom Brennan on MoneyTalk and it made me feel less alone in this battle. I ended up in hospital following an overdose because no-one at NatWest would talk to me about the problems. I'm going through the correct process via mail, but the email comms with Natwest have been horrendous. I've finally thought 'poop or bust' and am going the whole hog!

Here's my last email to them... have I peed in my prunes?

    [Good evening Mr Dix.

Thank you for your email and I can confirm that I have received the
standardised 1st class posted letter of April 17th 2007. As stated in that
letter I appreciate you are experiencing unusually high volumes of
complaints at this time. I am not at all suprised by this. This, however,
does not assist with my complaint and is, quite frankly, not my problem.
While your delay in responding means little to your company it has a daily
impact on my finances. The fact that the charges inflicted on our current
account have been 'transferred' to an increased overdraft incurring
increased interest charges with an crippling repayment plan, the charges
incurred by the companies whose direct debits your bank initially
dishonoured when monies were available for their payment at the time and the
delay in addressing this very serious matter have left me no choice but to
take recourse through the Courts. I have written to Natwest advising them of
this. In addition, I have sent particular copies of my statements requesting
an explanation of some charges, not included in my original claim, and
their breakdown on 31/03/07 and have yet to receive even an acknowlegement
    of their receipt.

I would like to advise you that, considering the immense impact Natwests
actions and inactions have had, not only on my finances but also my well
being, I am now pursuing aggravated damages in my Court action. I am taking
advice as to whether I shall pursue exemplary charges. Certainly the
requirement to increase my overdraft to recoup the charges made by Natwest
are indicative that Natwest prompted this action to make profit from
    unlawful charges.

Please ensure that this email is acknowledged within 78 hours.

    Regards

    Larraine]

Sorry for the length of it.
:j Proud to be dealing with my debts:j

Mornin' all, hope everyone is well !!!!

If I can be a bother, I have a couple of questions please if anyone can help..........

    1. Can you add very recent charges incurred even though it will take you over your 5 or 6 year time scale ????

    2. I am about to send off my 2nd letter with charges totalled, do I have to make a photocopy of my bank statements with the charges hightlighted on each page, or would the charges listed in calculator for this web site be sufficiant enough ????

Sorry to be a bother xx
  • Hi @ll!

After claiming succesfully my bank charges in October 06 from the RBS, where I had to sign a letter saying the charges must stand in the future, I now slipped over my overdraft on the 22.03 by 5 pound a day before my wages came (23.03). They now charged me yesterday (23.04) 28 pounds without even sending a notice.
I want to claim these 28 pounds back, because despite signing that agreement the charges must stand in future it is still not fair because of 5 pounds.
I am just a bit concerned that the RBS would cancel my account and force me to pay the overdraft back immediatly.
Has someone had the same problem or knows what I should do?

    Thanks!
  • Re:Nationwide. I wrote to them requesting refund of costs. When they refused, I started proceedings MCOL. Nationwide said they would defend my claim. Just before the date of the claim they proceeded to pay monies into my account.
. They have not closed my account but have threatened to do so, if I incur further charges.

Hiiya hen............to be honest honey, I think to a certain extent even though those of us lucky enough to have reclaimed back our bank charges there hasn't yet been anything set in stone that has set a standard bank charge, and the OFT is as far as I am aware still re-veiwing banks and thier charges before they put foward thier suggestion as to what is a fair charge. Untill then, sadly I think banks will still keep their set charges:mad: driving us all  , but can I also suggest that it may be best NOT to try and reclaim the recent bank charge if you have already signed an agreement becuase that would be you going back on your agreement with them...........but then again I could be wrong  just a thought though !! Think that is why some of the banks are getting people to sign these agreements so that they DONT come back at a later date to re-claim...........    it makes me furious all the same that they can get away with it!!!!!!!!!

Hope I have been of some help hen xx;)
