hi, can anyone advise me on wich address i should put on my claim form. i am filing my claim on mcol against lloyds, should i use my branch address or andover recovery address in hampshire which is where my local branch forewarded my template letters to, not quite sure if i am taking my branch to court or andover recovery, as they have been the ones responding to my letters and not my branch where i sent them to
    thanx debi
I sent mine to my local branch which is what I was told to do by the bank itself when I called to ask about ordering my past statements. I had to laugh cos he knew exactly what I was planning to do and why I wanted them LOL

Hiya, im currently in the court process with halifax and am due to set judgement by default tommorow at midnight. I have had an offer through for 770.00 when my amount is 1145.00 plus 120.00 court costs. Does anyone know what I should do. I am going to ring the bank asking for all tommorow but if they do offer me it should I still set the judgement as the money is not in my account yet.
    Thanks in advance
    Lindsey

I would do exactly what twinkly said and dont accept offer as in theory you have won!!!!!

I would hit the default/judgement button at midnight tonight and to be quite honest i wouldnt even bother ringing them either:money: :T

I filed an MCOL against Halifax on the 17th April 2007 after giving them the 14 days or commencing court proceedings after receiving the santdard 8 weeks to investigate letter.

So really not counting the weekend it should be served to halifax today:D

But one question do i now count 14 days from today inc. weekends?????
or do i not count weekends?:rotfl:

That is the correct address and send your second request by recorded delivery so you can prove it was posted and received. You can track its receipt online at the Royal Mail site. You may find you have the same trouble with the rest of the institutions you are claiming from but lets hope not. Good luck :)

Hi, newbie here ! I have just had a knock back from Nationwide refusing to refund my charges of 250 quid. I wrote them a nice letter based on a template from the ombudsman website ( I didn't threaten them with court)
They wrote back 'sorry......blah blah, term & conditions blah, onus on me to have funds in my account...blah blah.. it wouldn't be fair on the other society members who have not had refunds blah blah'

I will now write back not so nicely saying that I am disappointed with their response & that I am giving them an opportunity to reconsider their decsion & refund the money.

But before I do does anybody have any experience with Nationwide ? I thought they were one of the better ones. I have heard that Nationwide may close your account, is this true ?

    Hi

I am new to this site so any help would be greatly appreciated. My bank (Abbey) has filed a defence in respect to my claim (£456) and I recently received a letter saying that my claim has been transferred to my local court. The bit about the allocation questionnaire was crossed out and thus no questionnaire was enclosed.

    So what now?

Is it worth me writing a letter to the judge requesting that he/she order standard disclosure? Can I make this request without an AQ? I have read that an AQ usually comes with a fee so if I send a letter making the same request, but without enclosing a fee, would they accept it?

What happens if the judge throws out the case instead of giving me a court date?

    Thanks!!
