On the HMCS website it asks if my claim includes any issues under the human rights act 1998. Do I say yes or no?
Am just claiming the bank charges and interest from HSBC.

Hi All,
I've been reading this forum for a few weeks and am in the process of trying to claim £8187.46 back from First Direct.
I'd like to hear from people who have had experience of claiming charges back from First Direct if possible.
Using the standard letter templates from this website, I have already gone through Process One of totting up the charges I am reclaiming and sending off the first letter to First Direct (which of course was declined).
On 26th March, I then sent my second letter into the bank once again asking for the charges to be refunded and informing them that I intended to pursue this through the courts if they did not settle within 14 days.
14 days came and passed as of yesterday (though both yesterday and last Friday were public holidays). I am just wondering whether I have given them enough time now and should start court proceedings against First Direct, or whether I should wait until later in the week (given that two of those 14 days were bank holidays) ?
Any advice from First Direct customers who have gone (or are going) through this process would be gratefully received. I have noted in many posts on this forum that sometimes FD just pay up on receipt of the second (court threatening) letter, but have also noted that some did actually have to go as far as issuing court proceedings against FD. I'm wondering what is the norm with this bank ?
P.S. I've also started a similar process against Smile to reclaim bank charges that they have applied to my account over the past 6 years - am still waiting for my statements from them. Been waiting almost 10 days for the said statements from Smile.

I'm new to this and have just sent letter 1 to 9 banks and credit card companies on 31.03.07 asking for amount of charges. Hopefully this will knock some money of my £70.000 + debt !!:sad:0

Hi, I hope that this is the right place to write this but I am very frustrated. I wrote to the Clydesdale Bank asking for copies of my charges (with the £10 cheque required) and about 10 days later got a reply saying that they had received my paperwork and were working on it. I then received a letter on Friday of last week advising that they would not be able to get the paperwork to me in the 40 days due to there being so many applications. I called them this morning and asked how long they thought that it would take them and they advised that if I had not heard anything within two weeks to give them a call back. My question is do I just wait? HELP!!!
The problem is that the banks are inundated with request for 6 years details. However it isnt your problem, its theirs. Practically it may be a while before you get them but if you dont receive them in the statutory 40 days you can complain to the Information Commissioner for the breach of your rights under the Data Protection Act.0 -

Many thanks for that. It is difficult to know whether to complain to the Information Commissioner or not - I think I may wait the 14 days and then report them if I get no further.0 -
Hello All
I have started to claim end of December for £3000 over last 6 years and now received a letter from the county court asking for a schedule of evidence, copies off all statements.
The problem is that I have only a few statements (but am convinced the amount is +/- right) but do have a letter from Barclays willing to pay £1000 without admitting anything!!
I am afraid that the judge will strike out my claim if I go with only a few statemenst or will the letter with estimated charges and a few statements do the job.
At the moment my financial status is way over my overdraft limit (which the bank is not stopping as I can still withdraw cash which is strange in itself) so I ahve not got the time for a DPA request etc.
Please let me know if you have any relevant information as I need to get the evidence (or lack off) to court by friday 13th (how appropriate).

My housemate has had daily charges off the yorksire bank at a daily rate £5 for every day he is overdrawn. Can this still be claimed back as one day is not extortionate but i suppose 10 days would be. So would these charges count as illigal ?0

I have given my bank 40 working days to send me the info I requested under the Data Protection Act (along with a cheque for £10.00) and they have failed to send this to me.
I have sent them another letter stating that I will be claiming an estimated amount in charges as I am unable to give an exact figure. I gave them another 7 days to respond to this and as of yet have not heard anything.
Should I now proceed with court action?0
