    I too got an 'Acknowlegement of service' from Natwest. There are stalling for time. I fell foul of the 'MONEYCLAIM' online court system so beware. Natwest had 28 days to file a defence, they didn't and on the 28th day I filed for judgement (basically means they could no longer pursue me through the courts and had to pay up immiediately), but the MONEYCLAIM system failed and I had to send a fax instead.....WHICH TAKES MONEYCLAIM 5 DAYS TO PROCESS! So as far as Natwest were concerned I hadn't filed a defence within the 28 days, so two days after that deadline they filed their own defence. So I reckon they apply at each stage just in the hope that you'll bottle it - DON'T. What are the chances that you'll be the first out of thousands to not get their money back? I'm in the final stages now and got a letter today from Natwest's solicitors stating that they have asked the judge to 'strike out the claim' becauseI didn't response to their' Particulars of Claim'. I'm going all the way - so should you......good luck

    hi all
    my partner had a letter this morning from halifax with regard to her request for £2109.00 to be repaid. the letter says that they have 40 days to respond to complaints blah blah blah..... So i am in the process of writing a letter saying this is not a complint - merely a request to have her money. Is this right ?? also, all she uses this account for is for child benefit and tax credit to be paid.... but they still are taking their charges out when they feel like... am i right or not but i was led to believe that it was illegal for them to take benefits from your account in this way.... if this is the case could someone please point me in the way of what the actual wording for this is.... i will put this in her letter also..... this may jee them up....
    if anybody can advise us anything, we would be most grateful.
    also chasing natwest for £2500, £1150 and just short of £900 for three accounts. just sent first letters on these recorded delivery. wish me luck. what are other people dealings or feelings with natwest??

    Does anyone know if its too late for me to complete a N224 particulars of claim form if it's after to 14 day notice period given by the bank? (The deadline was the 28th March). If not, does anyone have any advice on what to put in it. It costs £35 to do, so I don't want to fill it out if it won't be accepted by the court.

    You need to complete the N224 'Particulars of claim' form from MCOL. It costs £35 (cannot claim this cost back). I would speak to the MCOL helpline first, they should be able to advise you that this is the correct form to complete.

    On this note - does anyone know if you can still complete the N224 form after the banks 14 day notice period. The bank defended my claim and gave me 14 days to expand on my particulars of claim. I have missed the deadline by 2 weeks (I only found out about the N224 form today!!). I want to keep persuing my claim as I've already spent £220 on the court process so far. Also, does anyone have any advice on what to put on the form??

    I sent a letter off to claim back my bank charges from HSBC. I sent the fist letter and they wrote back they are looking into the matter but would get back to me. Then i send the second letter without a reply. I then decided to go ahead and Proceed to MCOL. And this was submitted on the 4.4.07. I then realised that i had missed some charges for 2005. They amount to some £300 which is alot of money for me.

    The questions is how do i go about reclaiming these charges as well. Do i send out another first letter highlighting the mistake i had made or what do i do???? How do i alter the MCOL:confused:

    Hi everyone.
    What a brilliant website it has helped me alot. At the moment tryin to claim £4131 in charges from Abbey they gave me 590 as a goodwill gesture and now in a mcol claim process.Also just sent off for oh charges for alliance and leicester there charges are terrible. Abbey have until the end of the month to hopefully get a refund so fingers crossed.

    Some advice please!

    I have many accounts with the Halifax.

    My main account was opened in England, my savings in Scotland and a couple on line.

    I am now back living in Scotland and the charges apply to the account still held in the English branch.

    Can anyone advise if I am able to claim 5 or 6 years charges??

    BUT, now need some advice..PLEASE !!

    OK.

    Got my statements from HSBC without to much of a struggle.

    One personal acc. one Business.

    The manager at my branch told me before i had done ANYTHING that they (HSBC) would NOT accept the statements with the charges `highlighted` out.

    He said they MUST be in order and as a schedule of charges.

    This i have done, setting out

    The date
    The description ( exactly how HSBC has written them on my statements)
    The amount.

    I sent both accounts worth of charges off, along with the letter
    giving the bank 14 days to refund charges....etc.

    This morning a letter arrived from the stating that `In the absence of an auditable schedule in the format of date/charge type/amount, this is rejected...( the amount claimed is 5,396.82.)

    HSBC have HAD the schedule, in tha exact format they requested ??!!...

    They go on to say..`if you wish to pursue this matter,please write to us again with a specific breakdown detailing the amounts and dates of the charges in question,whereupon we will be able to considor your request`


    Errr, ive already supplied them with the info, so are they stalling, or just a bit SLOW ??...

    One other point im NOT 100 per cent sure about,is the charges that can be claimed and the name they come under on my HSBC statements..

    For instance, i havnt claimed any interest charges they have made, or for fees for money ordres.

    I HAVE claimed what they call`total charges` `quiring charges``charge recall`card recovery fee`..these are all amounts they have charged me and TAKEN or ADDED on to my account (or overdraught)

    HSBC say that `Total charges` is insufficient as it comprises a number of various charging components which must be split out and itemised for the purpose of your claim` ???


    Its there in black and white on the HSBC statement...`Total Charges`
    Thats what they call it, how would I know what the make up is ??

    Another stalling tactic ??...

    Finally, the letter go`s on to say `In your letter,you have highlighted the unfair terms in consumer contracts regulations 1999. These do NOT apply to business customers as they are not consumers for the purposes of the regulations- a fact thit is confirmed by both the OFT and the DTi on their respective websites...



    So....whats my next step ???

    Any/All advice GREATFULY accepted ....

    Your branch address is normally at the top of your statements or on your cheque book.
