Hi all! I am at the 'take to court stage', I have filled all the info in at moneyclaim, but they don not accept my debit card, I dont know anyone with another! What can I do? Or is it the little man/woman loses again!
    Thanx
i had this same problem and got my mum to pay for it and gave her the money.

but to agree with Twinkly it's just as easy to go to your local court and file there too!
    halifax: settled paid £2622.18:j
lloyds tsb: £1038.83 inc interest, but claim on hold.

Was the £1220 the full amount without interest? If so, i was advised on here that i had to accept it, as interest had to be awarded by the court.

As for the defense letter, i have had one from Lloyds TSB. I have been told its is scare tactic, and that they will pay out at the last minute, so fingers crossed.
Thanks for your reply the amount of the claim without interest is £1436. I know many people will think he should have accepted the offer of £1220. But if these charges are unlawful, then I believe they should pay back every penny with interest.
  • Hello everyone!
Im new here! i have just sent letters to 5 credit cards to claim my charges back, i dont owe anything on them now though! could i please just ask, the bank charges that you can claim back arent your arranged overdraft interest thats added each month is it? is it just the money penalties they put on your current account for bounced cheques direct debits and going over your arranged overdraft isnt it?

    thanks
    Phil

edit.. just see your post cookiecrumble, im of the same mind as you! i think if they have done something unlawfully then they should pay up with interest... ive just been back to watch martins video! great confidence booster! im sure all banks will put up some form of scare tactic, lesser offer, lies and loosing things and many excuses just to make it as difficult for you as possible! good luck !!
Reclaimed unfair charges on 5 credit cards, £1,800 :T got all my money plus 8% interest and court costs :T chuffed to bits! cheers Martin!

Hi. I have a couple of questions. After recieving the letter from Lloyds trying to fob me off: http://forums.moneysavingexpert.com/showpost.html?p=4796737&postcount=5039

I am going to write them the second letter (Which is Letter 5 I believe - I refer to default charges applied to my account amounting to of £
which I have requested you pay back.)
Is this the correct letter to write next? So I send this one, then if I don't get a satisfactory response I go to MCOL?
Which court would I use? (Norwich) http://www.hmcourts-service.gov.uk/HMCSCourtFinder/
    Magistrates?

I'm a little aprehensive if it does go to court. I've never been to court before. Do I just go in there by myself. Do I need to prepare a list of questions to put to the Bank representative, to make my case? And sorry, if this seems like a daft question; what do I wear? shirt and tie OK?
(Sorry for all the questions, I know you all say one step at a time. I just want to be prepared, and have the knowledge - knowledge is power!)
Also one other thing; On the statements I printed from my online banking it says: "The personal data on this statement was correct at the time of printing. This statement is not an official Bank copy."
Does this mean anything in a court??
  • HI guys
i have been following tips i have found on here for a while ,
could any one help out with 2 questions i have please?
i have 2 claims against lloyds one thats with money claim..and at the stage where the bank has put in a defence on account that they have paid us ? they put 750.00 in to out joint account as a good will guesture, for us not to take the case to court ,but told us if we did take it to court they would deduct that amount from any money we would get as a result .. the letter did not ask for a reply ,and we had already decided to continue with the case. would anyone know where we stand now ?
after a letter sent to them about the money they owe me on my sole account, the normal letter arrived saying (no)so i rang them and was told over the phone they were going to pay me out in 2 /6 weeks ???has anyone been told that here ? for some reason i feel im not going to get it !!

I am thinking of entering the charges and interest calcualtions into an Excel spreadsheet. Could anyone tell me what formula is used to calculate the interest. (Sorry, maths is not my strong point!)

Just use the calculator that is on this website to get a figure with interest

Just to clarify, no-one is saying that you/anyone should accept an offer less than the full amount of your claim BUT if the offer is the full amount you must accept it as the interest is only applicable should the case go to court.
