Charges of a sort.
Good news yesterday with the FSA striking a deal with the trade associations that represent the majority of PPI providers. It means that Insurers will no longer apply nil-refund clauses to contracts. This has been described as a
major victory in the battle against rip-off loan insurance (credit cards as well)
has been won with insurers agreeing to offer 'fair' refunds when customers cancel policies. Interesting articles on thisismoney.co.uk campaign section.
I've been wondering about PPI, as well as the rest of this reclaiming lark this is an issue I should address too. Not having done any research on it I wonder if anyone can advise me. I took out PPI when I took out my Capital One card to guard against unemployment. I technically did not become unemployed since I was 'retired' from my usual workplace on health grounds.
I dislocated my sacroiliac joint (where the hip/pelvis meets the back, not the leg) in a nasty fall straight after the birth of my first baby and nobody knew I'd done this so I was a bit of a mess and couldnt return to work after Maternity Leave. I claimed on the PPI and they advised me that since the claim was due to an injury sustained 'because of childbirth' they would not pay out.
It wasnt actually due to childbirth as I found out 2 years later in a visit to a chiropractor in desperation at the pain ! Do I have a valid case for misselling or at least misleading me to the reason for refusal ? I suppose technically they couldnt have known about the injury any more than I did at the time but would it be too late to do anything about getting the PPI back ? It was 9 years ago now.
Any advice much appreciated0 -
hi there looking for some help my wife and i have a joint account with over £3000 in charges were in the court stage of reclaiming or court is in scottish law states i can only claim £1500 max wanted to know if my wife and myself could both put a claim into the court and get a sucsess otherwise i have to pay a lawer
Since it is a joint account I cant see why you cant claim half each and do it that way in your own names. I hope I am right but someone else may be able to advise you better. Good luck with it though0 -

I advise to stick to your own timescales. They have entered you into their own complaints procedure but you dont have to follow it. Good luck0 -
Hi all! I am at the 'take to court stage', I have filled all the info in at moneyclaim, but they don not accept my debit card, I dont know anyone with another! What can I do? Or is it the little man/woman loses again!
Thanx0 -
Hi to everyone,
I have car finance with Capital Bank, a Royal Bank of Scotland company. On a few occasions I have been late paying my monthly payments.
The charges are very similar to bank charges relating to Current Accounts. £22 per letter. £10 telephone costs etc.
Has anyone attempted to claim back these charges or does anyone think it is worth trying to claim them back?
I am just over a year away from paying off the outstanding on the car.
Thanks SU0 -

Not at all. Go to your local court and file your claim there instead
You can find your local court address here :

Hi
I am claiming £1587.56 including interest on behalf of my son.
He was offered £1220, which he refused.
So we filed a claim with the courts on 26th March 2007. Today he received from the court a 'Notice that Acknowledgment of Service has been filed'. This states that FD 'intend to defend all of this claim', and they have 28 days to prepare a defence. This sounds scary!!
Has anyone else received one of these notices? If so what was the outcome?
Might my son have to appear in court?
Or is this just designed to scare him, in the hope he'll back down?
By the way FD have switched his £1500 overdraft onto his credit card. So if he is successful in this claim he can pay it all off and be debt free. (He is moving back home this weekend so if he goes into the red again I shall be confiscating his credit and debit cards!!);)0 -
