My friend panicked about the OFT, and only claimed for the charges he had statements for (£1000 approx over 11 months).
Today, 2 weeks later, he was offered the £1000, but as the OFT have now delayed, and should not affect things anyway, he wants to go for the full 6 years, starting with sending for statements.
He has also been charged another £200 since he first contacted them, so the offer is already in affect out of date.
Can he ignore the offer, and start from scratch, or should he accept the £1000.

I have just received an Acknowledgment of Service, and that the bank intend to defend my claim. Does anyone know if this is a delaying tactic or have the banks decided to fight in the courts.0

This is a standard fob off letter commonly seen and it is designed to confuse you dont worry. Your aim is to reclaim charges made to the account that are excessive to their costs and thats all that matters really. Disregard it and carry on with the next letter. Good luck

Hi I'm a newby at this but have sent off a letter to my bank regarding claiming my charges back yesterday. I was wondering does this also apply to business accounts as I,ve had some hefty charges from RBS in the last two years and was wondering if I can claim them back too. Would love some advice on this please

Reassure your friend that the OFT announcement would have had no bearing on the lawfulness of the amount the banks charge. Further that unless they bring the charges down to reflect the true costs to them and declare what they are then we can still reclaim in court.
Yes he can start from scratch, rejecting the offer and sending off for his 6 years details. He can follow the templates and timescales laid out in the main article. Tell him to make sure all communication is in writing, he keeps a copy of his own and sends it all recorded delivery. Good luck to him.

This is my first time on this website and I would be grateful for any advice on my current situation. Fourteen days ago I settled with the Halifax for £2500. I Received a conformation letter saying that the money would be paid into my account in 14 days time, not 14 working days. Well the time is up today and nothing has been paid into my account and I keep being told to be patent by their complaints department. Is this just a delaying tatic or is they anything I can do to either speed up this process or do I just proceed with court action. Any help in this matter would be gratefully accepted.
If they have agreed to pay you then they will. It doesn't matter whether they have stated 14 working days or not it IS ALWAYS 14 WORKING DAYS.
So count 14 working days and if they still have paid up then telephone them and see what is occuring. Also ask for a letter confirming your conversation.

It can be a delaying tactic although some banks do issue a defence. You may or not be sent an allocation questionnaire if they do as the judges sometimes do not issue them (this is a recent development) because the banks sometimes do not turn up at court and the judges are getting fed up with it basically.
They have 14 days to issue a defence so just wait and see really. Good luck

also can any one tell me what a referral charge is and can i claim this back seen
this on my statement a few time
I dont know the answer exactly. It sounds like an 'unarranged borrowing fee' where the bank pays on a direct debit or similair for instance where there arent funds available. I could be wrong so please get some more advice perhaps from someone who has an RBS account and can advise exactly. Sorry about that
Edited to add: a little further reading tells me yes, you can reclaim this.

I haven't even had a response from HSBC yet - wrote to them on the 13th December asking for statements for a closed account that I had with them. That was closed in 2001, as far as I can recall - I want to reclaim charges going back to 2000, which I assume I'm entitled to. How long does the Information Commissioner take to get them to send information, as I don't currently know what I want to reclaim?0

You can claim off a business account but some of the names of the charges are different and there some you cant claim. Someone else may be able to advise you more specifically with exact information on charges, sorry I cant
