  • I have check through my halifax statements and sent a letter off asking for my charges back. I have put a list of dates and how much but I don't have the reason as all my statements say are notified charges. does this make a difference

    Hi, i'm on this thread again, wondering if anyone can help with someone elses question on another thread (thanks to Twinkly for helping last time)..........

    I am with Natwest in Scotland and am due back £5000+ and interest thereon which amounts to a further £1200.
    I have written first letter and their time is up tomorrow but I now realise I am over the limit for a small claim in Scotland. I am willing to 'hang on in there' and ride this out no matter what but can anyone advise what I should do next?"

    i filed with moneyclaim today. my timeframe was ignored so i went ahead. my attitude is that when a bank sets a timescale they expect you to act within it so why should they ignore the timescale you set them??
    halifax: settled paid £2622.18:j
    lloyds tsb: £1038.83 inc interest, but claim on hold.

    I received a letter saying that i was charged fairly and all that however as a gesture of good will they are willing to refund me £1400.00, i am considering if i should accept this or not.

    It is £800 short of what i asked.

    What is everyone else's view?

    In addition to my last post, the person lives & banks in Scotland but her husband lives in London, is there a possibility of her claiming in an English court?

    No it doesnt. The reason you are claiming as stated in the template letter is 'I do not believe these charges reflect the true cost to [INSERT NAME OF BANK].' It will be up to the bank to prove in court that the charges are a true reflection of any cost they incur. :)

  • Hi guys

    I sent a letter asking for a refund of bank charges and got a letter saying that my complaint was being dealt with and they would write to me in 4 weeks. Last week I got another letter saying they still had not been able to fully investigate my complaint and they would get in contact with me in another 4 weeks unless there was a conclusion beforehand. I feel that this is a delaying tactic, any advice on how to deal with them? Anyone had a similer experience?

    My friend panicked about the OFT, and only claimed for the charges he had statements for (£1000 approx over 11 months).

    Today, 2 weeks later, he was offered the £1000, but as the OFT have now delayed, and should not affect things anyway, he wants to go for the full 6 years, starting with sending for statements.

    He has also been charged another £200 since he first contacted them, so the offer is already in affect out of date.

    Can he ignore the offer, and start from scratch, or should he accept the £1000.

    I too have filed with Lloyds TSB, but they replied rejecting the claim. Their solicitor has filed for an extension, and they now have another 28 days.
