I am claiming £1587.56 including interest on behalf of my son.
He was offered £1220, which he refused.
So we filed a claim with the courts on 26th March 2007. Today he received from the court a 'Notice that Acknowledgment of Service has been filed'. This states that FD 'intend to defend all of this claim', and they have 28 days to prepare a defence. This sounds scary!!
Has anyone else received one of these notices? If so what was the outcome?
Might my son have to appear in court?
Or is this just designed to scare him, in the hope he'll back down?
By the way FD have switched his £1500 overdraft onto his credit card. So if he is successful in this claim he can pay it all off and be debt free. (He is moving back home this weekend so if he goes into the red again I shall be confiscating his credit and debit cards!!);)
Was the £1220 the full amount without interest? If so, i was advised on here that i had to accept it, as interest had to be awarded by the court.
As for the defense letter, i have had one from Lloyds TSB. I have been told its is scare tactic, and that they will pay out at the last minute, so fingers crossed.0 -
Hi everybody..
im totally new..
could somebody please tell me if when you send of 1st letter do you just tell them how much they owe you or do you send your statements back highlighting the charges or just photocopies of statements..??
sorry to be thick!!! im with natwest..
im totally loving this website & everybody's own experiences and advice.....
many thanks
Welcome to the forum jonun.
Use Martins template letter and attach a spread sheet of charges stating what the charge is, how much and the date. If your requesting interest too (which is what the court will award) then use Martins calculator to work this out.
Good luck

StraightUp wrote: »Hi to everyone,
I have car finance with Capital Bank, a Royal Bank of Scotland company. On a few occasions I have been late paying my monthly payments.
The charges are very similar to bank charges relating to Current Accounts. £22 per letter. £10 telephone costs etc.
Has anyone attempted to claim back these charges or does anyone think it is worth trying to claim them back?
I am just over a year away from paying off the outstanding on the car.
Thanks SU
StraightUp go for it.
People have claimed and had success. It still a charge that's not proportionate to there costs.

Hi just wanted to say i'm in the same boat with Llyods at the moment and am also very worried!!! I received 'Notice of Transfer of proceedings' letter today with Llyods intention to defend my claim was a bit shocked really didn't think they would actually go that far!! I'm claiming £1486 which includes £120 court fee, was offered £750 in a standard letter by Llyods which i declined and said would not accept as full and final settlement but would without prejudice accept as part payment that sum remains in my bank account to date and i haven't touched it. I'm not sure what i should do now and what the next step is scared stiff about going to court especially when court on the letter is Northampton and i'm in plymouth. Any advice would be appreciated. Thankyou.0

thankyou TAFFYFELLA for that quick response..XX
im still learning and not quite sure yet how i thank you properly!!
I rang natwest on the 2nd april asking for bank charges they said they would send them out, with no charge.. and was no need for me to request them in writing..they said i should have them within 10 days.. i dont trust them anymore so i sent a letter requesting them anyway...
i then got a courtesy call the next day informing me of the right address to sent 1st letter to..
they seemed to be really helpful...bit suspicious tho....Time will tell..eh??0 -

Hi Suz75,
I'm claiming from Lloyds to and they have acknoledged my claim.
I think the next step for you would be for an allocation questionaire to be sent in the post which you fill out and send back. The case will automatically be transfered to your local court.
Don't panic your not in limbo, all will become clear as you start receiving the correspondence. If you need help with the preperation, it's all on here.
I don't know why Lloyds take it so far, just costs them more in the end!
Can I ask you a question? When they paid the money into your a/c, what was the description on your statement?

Sounds ambiguous!! If you like the response you can click the thumb sign on my post..
Banks are doing anything to put you off claiming. Stick to your guns as your already doing ( excuse the pun) and you will be laughing all the way to the bank!!
