The vast majority of all claimants get all their money back. Similarly there are only a handful of cases that have actually ended up in a courtroom. There will be some outlay paying court fees if your claim gets that far, but you will get these back.0 -
I've just started a Moneyclaim claim (if you know what I mean) and I've gone and exceeded my authorised overdraft. It happened yesterday and a direct debit and a cheque have gone out - yet more charges.
Will this affect my claim - will they be able to use this in their defence? Will this give them the right to shut my account because they said in one of their letters that they reserve that right if the account isn't conducted properly.
Never ends does it! The fact I've gone over might be because I never seem to get straight because I'm paying them ridiculous amounts of money but they don't see it like that do they.
Rant over. Just very peeved now.

Hi. I bank with the Northern Bank in Northern Ireland and am about to request the necessary info from them. Has any one dealt with them in regard to reclaiming charges? Secondly when I overdraw it is generally by more than the bank charges me - does this mean I cant claim as their charges are proportionate to the amount I am overdrawn? P.S hope I can navigate this forum thingy!0

Hi Clarenic, it should not affect anything, dont panic. A lot of people have gone on to a second claim with their bank for all the charges they were still getting while claiming. So if the first time does not put you off put in a second claim when you have finished this one for any charges they are slapping on you at the moment!!!
Be warned though if they do not close your account down after claiming these back - which a lot dont, they probably will if you go and claim again, for some reason they dont like it :rotfl:Any spelling mistakes are entirely on purpose to check you're paying attention0 -
Hi all, i have just filled in the moneyclaim form and paid £120 to take Natwest Bank to court to reclaim £2021, i feel a little bit scared now, and was looking for some kind of reasurrance. Also if it does go to court, should i attend. would someone please be kind enough to advise me.

It's very unlikely to get to the stage where you need to appear in a courtroom, only a handful of cases have. Help is available if by some small chance it comes to that.0 -
Hi,
I am wanting to claim for charges but need a little advise first please.
I have two standard type accounts with LloydsTSB and a credit card and a loan for £10k. Basically was made redundant 4 times over the last 7 years & so got into some major financial difficulty.
The result was that I defaulted in just about every way imaginable & was charged in the thousands in returned DD, unauthorised overdrafts etc etc.
I have now remortgaged & sorted all the debts by offering settlement figures which were accepted by Lloyds & reduced the amount on every one by over a third, so asbout £19k of debt to Lloyds became about £12k paid back.
My question is, despite the fact that I have paid the debts "in full & final settlement" can I still claim back the charges they made on those accounts?
Can they then come after me for the remainder and/or will they keep the charges as part payment?
Hope I have made myself clear enough here - trying to!
I would really appreciate any advise, thanks in advance.0 -
Im at the MCOL stage with capital one, If ive stated on my letters £784 without contractual interest can i add it at the MCOL stage as well as the 8%.0

posted this a few days ago....no one seemed to be able to give me an idea wondered if there was a fresh pair of eyes to point me.......during the years of '99 to April '03 I was unmercifully charged by the halifax, barclays and royal bank of scotland. At which point i went bankrupt. i was discharged from my bankruptcy in April '05. If I left these banks unpaid because of my bankruptcy would I still be able to claim against them. I still feel bitter against them as I feel they was a contributing factor to my bankruptcy!0

Have sent LBA to Bank of Scotland - and guess what - they've just emptied my current account towards paying off a credit card debt with them and said they'll continue to do so until I agree a payment plan. The guy also said that as I was playing dirty with them then they would do the same with me!!Thing is, I've offered plenty times but they always say they want more which I can't afford.
What should I do if I want to claim more than £750 in Scotland as they've taken thousands over the years (part of the reson I'm up to mu eyes in debt!!)
Finally - where can I get a 'parachute' bank account with my crap credit score???0
