  • I am in the throws of filing my claim on the Moneyclaim website and have used the pre written "Particulars of claim" statement however this statement is to long and goes over the 1080 charachters your allowed. Can anyone help or advise what i can remove or how I can get round this? Cheers. I want the money for christmas!!

    Are you trying to get two accounts on there?
    I tried that and there was nothing I could do to reduce it so I ended up doing it on two separate claims as it made it easier to read as well.
    I think otherwise you need to go to a court to get another form. I think it gives the name of that form on the CAG website.

    A few people are having this problem, try this one:

    Claimant has had an account 9Number) with
    defendant for over 6 years and conducted on
    their standard terms and conditions.
    Claimant is claiming the return of (amount)
    taken by the defendant in charges
    over 6 years. The defendants charges are a
    disproportionate penalty and therefore
    unenforceable as they are contrary to
    common law. They are also invalid under
    the unfair terms in Consumer Contracts
    Regulations 1999 Para 8 and sec 2.1.e. In
    the event that the charges are not a
    penalty they are unreasonable within the
    meaning of the supply of goods and services
    act 1982 s.15. Defendant has declined
    justification of charges despite repeated
    requests. The claimant claims interest
    under section 69 of the County Courts Act
    1984 at the rate of 8% a year from
    (date)to (date) of (amount)and
    also interest at the same rate up to the
    date of judgement or earlier payment at a
    daily rate of (amount)

    Thats from another which has been re jigged and it fitted fine.
    Any spelling mistakes are entirely on purpose to check you're paying attention :p

    This £12 is what the credit card companies were told was more like a fair amount, so this is what they all charge now instaed of the larger ones they charged before.

    Well I've finally went ahead and send in the initial letter to my bank requesting the charges but... I put 6 yrs but I live in Scotland and only just read earlier in this thread that its only 5 yrs for us Scots.

    Those that have had the costs from the Lloyds TSB, can I ask do they really break it down into months/year for the charges, that way I can ignore the initial year if you see what I mean and just work out the 5yrs. I'm just wondering how detailed the info is they send you.

    My letter only went in the mail this afternoon as well, with the payment, and I would hate to have to send another one apologising that it should have read 5yrs. Looking unprofessional right at the outset!

    You should get a list of charges with dates and whatb they were for, so you will be able to extract what you need. Don't worry and good luck!

    I would check with them what this is, and then ask for a copy of the agreement that you signed and a transcript of the call where they explained to you what it was and you agreed to pay it. If they can't prove you agreed for this to be taken, then you may have a case. It sounds like insurance.

    I'm not sure, this is the advice from the CAG website. Maybe wait 'til they file a defence and then send a copy to the court that your case is allocated to.

  • I am going to go about trying to recalim past bacnk charges which have been racking up since i changes my job last year. Basically my income became split into two parts but my outgoings stayed the same i.e. things coming out at the same time of the month. Over the month there was enought money going in but as you can imagine half way thorough i have been going overdrawn and being given these serious charges £25 her upto £100 at times.

    I am new to posting on this site and have read a few stroies which seem to be of success, i dont fancy court, i dont understand it have never been and have i suppose a preconception that it would be expensive? in general do people get these charges back or at least most of it?

    any replys appreciated. Thanks
