I have just been reading all the posts for today and yesterday and I can't believe how nasty some people can be. I think most of us here have left school a long time ago and need to stop being pathetic.

You have always tried to help others and answer the questions as best as you can and I want to say a big THANK YOU to you because by reading your posts both on this thread and the Abbey thread, I have learnt a lot and felt encouraged to carry on with my claim.

Just wanted to say there are lots of people that appreciate the time you put in to answer the questions and I hope a certain person hasn't put you off. xx

Can anone of you clever people help me with this. Long post but once you have read it you will understand.

Sent first letter to Marbles asking for money back with list of charges.
Had letter back today stating charges are fair etc etc.
However it also says, and I quote:-

"The OFT has recently published the findings from its enquiry into default charges on credit cards.HFC has carefully considered the OFT's publication and does not accept its findings. However the OFTs investigation has led to a change in market practices and HFC has therefore decided for commercial reasons and in the interests of customers, to reduce its credit card charges for the future. These changes do not affect charges that have already been applied. Accordingly I regret that we are not prepared to make any refund of default charges or provide any compension payments".

Now is this a stalling tactic, them thinking I'll go away. - has anyone else had the same response from Marbles (HFC) and ended up getting there money back?

Letter 2 was due to go out next week - do i send it or go straight to MCOL?

    Any advice would be appreciated.

Send your second letter out in the correct timescale, be strong and you will get there in the end:)

    I need help please.

I wrote to Lloyds the money grabbing bar stewards, asking for my charges to be repaid. They have responded today with a letter to say they are looking into my complaint and expect to contact me with their decision within the next four weeks or eight weeks (they cant seem to make up their mind).

Do I proceed with my follow up letter or wait the time scale they have given me?

Waiting in anticipation to any reponses.

The Scarlet Pimpernel - I will ask you politely to desist in this discussion. It is of no personal interest to me further and is disruptive to the thread. I consider your point made, as is mine and for my part this discussion is now closed.

I apologise to all not directly or personally involved for any disruption I have caused as a participant in defence during this unneccessarily drawn out and pedantic discussion. I endeavour to now bring it to closure. Further post in perceived deconstructive harrassment of myself by this person on this subject, or indeed any other, will be reported as a disruption to the continuity of constructive help on this thread or forum.

My final word on the subject is that my initial post regarding specific query about a specific bank and pertaining to this site was correct in its assertions. To clarify once and for all. I will answer any query that is the result of genuine confusion as to the exact nature of an entire post but I will not be harrassed to admit a mistake I have not made - by anyone, regardless of their meandering and deliberately confrontational miscontrual of one sentence in one of my posts. Further I will not respond to personal remarks about myself or the manner in which my help should be undertaken.

Additional information is welcome where it is relevant to the initial query, confrontational argumentative deliberation is not. I have no ego at stake and have clarified this matter multiple times now. There is no justification to get personal about the matter in hand and I do not comprehend why it is neccessary to do so. It serves no purpose. I am here to help and that is all. I will now continue to do so.

    Thank you.

thank you caleyles, I will do, but do you think a call to the name on the letter will help any. I read in some previous posts where someone got a similar letter to mine, they rang up and HFC caved in what do you think. Should I give it a go?

Hi I think that I will be able to claim my charges, as I am receiving a financial service and they are penalising my for not paying on time, but can somebody please confirm this for me?

    Thanks,
A charge that is in excess of actual cost of loss is classed as a penalty. Penalties are unlawful under consumer law. Logic dictates that if the late payment charges are obviously in excess that they would be reclaimable under the Unfair Terms in Consumer Contract Regulations. As a Financial Service provider they are subject to complaint directed to the Financial Ombudsman so you may wish to explore that option further dependant on your circumstances. I hope that makes sense and helps in some way.
  • Hi everybody

I have read the article that relates to all this after my mother-in-law told me about this chance to reclaim charges. But she told me that I would need to send my bank a letter before April '07.

I do not have any old statements & would need to request the last 6 years worth before making a claim. Can someone please tell me if I have left this too late now to get the money back? because I am certain I'm due at least £2,000 back.

Thanks in advance for any advice

    Dave

It's certainly worth a try, make sure you get the name of the person you speak too, but if you have no luck carry on and hard as it maybe, don't let them walk over you we ara all going through the same processes one way or another and there is lots of kind people on here to help:)
