    Being here to help would be better achieved by accepting that you made a mistake. It is unfortunate that you seem unwilling or incapable of doing so, instead choosing to perceive it as a slight on yourself.

    No matter. The correct information is actually there for those who wish to read it, and despite your egotistical assumption that I posted to slight you, that was the sole aim of my intervention.

    For clarification, in case people lost track in the rolling rhetoric of your previous posts, I shall repeat:

    It is incorrect that no case ever got lost in court. For those interested on how and why, and learn from it, please go to the Consumer Action Group and search for Henry v Natwest. Henry's barrister lost the case for him, and Henry kindly posted his experience for the benefit of those who would come after him. It makes essential reading for those who would rush unprepared in their case and is all the more relevant now that banks are changing their T&Cs to incorporate a "service" defence.

    It is also incorrect that cases don't ever get to court. Barcote v Egg, Bookworm v 1st National Motor Finance, and the more I look, the more I find.

    The key in everything is preparation. Telling people to gamble on the fact that the bank won't go to court is irresponsible, especially when that advice is backed by inaccurate information.

    If one person reads this and takes heed, then that is all that matters.



    The Scarlet Pimpernel - I will ask you politely to desist in this discussion. It is of no personal interest to me further and is disruptive to the thread. I consider your point made, as is mine and for my part this discussion is now closed.

    I apologise to all not directly or personally involved for any disruption I have caused as a participant in defence during this unneccessarily drawn out and pedantic discussion. I endeavour to now bring it to closure. Further post in perceived deconstructive harrassment of myself by this person on this subject, or indeed any other, will be reported as a disruption to the continuity of constructive help on this thread or forum.

    My final word on the subject is that my initial post regarding specific query about a specific bank and pertaining to this site was correct in its assertions. To clarify once and for all. I will answer any query that is the result of genuine confusion as to the exact nature of an entire post but I will not be harrassed to admit a mistake I have not made - by anyone, regardless of their meandering and deliberately confrontational miscontrual of one sentence in one of my posts. Further I will not respond to personal remarks about myself or the manner in which my help should be undertaken.

    Additional information is welcome where it is relevant to the initial query, confrontational argumentative deliberation is not. I have no ego at stake and have clarified this matter multiple times now. There is no justification to get personal about the matter in hand and I do not comprehend why it is neccessary to do so. It serves no purpose. I am here to help and that is all. I will now continue to do so.

    Just a quick question.

    I am aware that companies have to keep certain records for so many years and after asking in my accounts department, they have said anything we have relating to any kind of contract agreement with a customer must BY LAW by kept on record for a minimum of 6 years after expiry.

    Does this also apply to banks?

    I am asking as Natwest are saying they cannot find details of my account as it is now closed so they have probably discarded my details but they still also refuse to remove any items from my credit file even though they can't prove I had an account with them. Just wanted to know if it was law for them to keep details as it will sound good in my next letter to them :)

    Hi, I was just trying to find the Henry v Natwest case on the Consumer action group web, but was unsuccessful. Could you maybe help? :confused: just point me in the direction of the correct thread. Thanks,:rotfl:

    Be patient with me newbie, I too have asked for my charges with 3 banks not had the charges sent to me just 2 letters from LLOYDS tsb telling me they are sorry that I have made a complaint and they will contact me in 4 weeks time I have not officially made a complaint as yet and also 1 from the Coop bank which I have recieved after asking for 370 pounds to be refunded and they have said they will be in touch by telephone or letter within the next 7 days which has passed.I have also asked for the total charges from my daughters Halifax account and sent the fee but they have not responded at all whats my next move.

    Thank you. For my part, your apology is accepted.

    In that alone I admit mistake and permanently withdraw the erroneous section of that sentence. I have corrected my error.

    Hiya :wave:

    Lloyds TSB - they have 40 days to send the infromation to you

    Coop Bank - Send the next letter threatening court action if they have nt responded in the timescale you gave them

    Halifax - they also have 40 days to respond
