  • leaf i think you are with natwest and somewhere here there is a guide to advantage gold and unarranged borrowing. That £40 is £28 unarranged borrowing(claimable) and £12 advantage gold fee(not claimable).

  • hi just wanted to make people aware of the following. I wrote to the RBS and asked for 5 years statements. in the last 5 years i have changed address 3 times.The point is that i work for the royalmail and guess where the RBS sent my statements to?The first address on the statements (common sense) i havent lived there for 4 years.I would never have got them if i wasnt working for the post office.Just making people aware.Totalled charges £2065.Wish me luck

    Thank you for that Nat. I now remember why the £9 is charged. We entered into the advantage gold thing purely to get a loan arranged. We then cancelled it days later (as suggested by the guy who set up the loan) but have been charged without benefit. We are told we do not have an advantage gold account but the charges are still there. Maybe this is another avenue we take up seperately from the other charges. Cheers.

  • Sent £100 of to the court yesterday, did try calling Barclays before hand but that was a laugh, lines totally bunged up!!
    Barclays are saying in their defence i have gone 3 dates over the 6 years, big deal. Also said i hadnt shown what all the charges were for although they would know in reality and they wouldnt have offered £1200 several weeks back if they didnt realise. Anyway on the interest calculator i have sent to the court i have put next to each charge exactly what it is for so at least the judge will know even if they dont seem to.
    Total claim is £2600 but now there is £220 of court costs to add to that.
  • I should also have said that i am now finished with MCOL the £100 was for the county court as Barclays are defending.
  • Hi, I've recently requested all my statements from HSBC for the last 6 years and have scanned them very closely. It seems as if i have only racked up around £130 worth of charges although i can remember getting charged that much in as little as 3 months once!

    Has anyone heard of the banks somehow leaving out charges from statements in a bid to get out of paying?

    Surlely this is not likely...
  • Hello there, I am a new poster to money saver. I started the claim process on 27 Feb with HSBC (charges of £1769), have sent the 2nd letter of settlement of 75% of £1300 - and have heard nothing back - not a word! I had sent the letters to my local branch in Fareham, was this the wrong thing to do? I emailed the complaints teams yesterday attaching my letters and fee schedule saying that I have not had any response and due to time constraints of my letters, intend to start court proceedings on 28 March (Wed) - is this normal not to have heard anything? I am now going to claim interest through the court and get back another £150 or so as I figure I may as well make it worthwhile now as I was willing to settle. Should I just go ahead and start MCOL? I have got everything ready to go. Has anyone heard of anyone NOT getting money back? Help and advice would be very appreciated! Thanks

    Unfair Terms in Consumer Regulations has a few points you might wish to bring to the banks attention on your situation.

    SCHEDULE 3

    Unfair Terms in Consumer Contracts

    1. Terms which have the object or effect of:

    ( d ) permitting the seller or supplier to retain sums paid by the consumer where the latter decides not to conclude or perform the contract, without providing for the consumer to receive compensation of an equivalent amount from the seller or supplier where the latter is the party cancelling the contract;

    ( o ) obliging the consumer to fulfil all his obligations where the seller or supplier does not perform his;

    You are being charged but have none of the benefits.

    If you have online banking with HSBC you can view your 6 years accounts online. If you dont sign, register for it. Check the statements you have been sent against the details online. You might be surprised ;)

    Its a bit odd that you havent heard anything at all. I'd give them a quick phonecall to see if there are records of the letters being received. This is where sending letters recorded delivery would have given you peace of mind.

    Proceed with the court claim and dont worry, if the court dont hear anything from them you win by default :p

    Not heard of any cases where no one receives their money back. HSBC tend in the main to settle in full with a few odd cases of lower settlement being accepted by the claimant. Good luck :)
