    Hello.
I now have my statements and most of the charges are pretty clear. I checked the can claim/ can't claim page and pretty much think the end of month charge relates to overdraft management fee... or something like that. But it varies month to month from £9 when the account wasn't overdrawn to £40. Should I assume that these are legitimate charges and not include them in my claim?
Many thanks for any help. This site has really been fantastic.

I would phone the bank and clarify exactly what this fee/charge relates to.
the way forward is the consumer action group .co.uk

Thank you feedering and Twinkly. Colour me lazy, but I reckoned at first glance that they might be overdraft interest, which seems a sort of reasonable charge to me. I want to just forge ahead now and the charges are not a huge deal compared with the others! So second letter off tomorrow for £1338 including interest. Good luck to me and all the others in the process of getting back! BTW, I sent the £10 cheque for the statements and was later advised they don't charge. Funny that, as I disputed a £50 charge for 20 statements in 2001 and got a refund! The rogues! (Natwest for those interested.)

    A quick update.
After filing for bank charges through MCOL, Bank of Scotland sent me a letter (received today) advising that they are sorry to hear that I am unhappy with theor charges and that they will look into my complaint, quoting upto 4 weeks for a reply? Spoke to a lovely woman at BOS complaints dept. who said she would have refunded the charges (£85) had I spoken to her initially. Apologised profusely and asked me to call her again when the court claim was resolved (either way). The first non-scripted person i've spoken to so far.

All of the people at the bank I have spoken to in this dispute have been [quietly] supportive. Any 'normal' person would be! However, 'non scripted' is slightly worrying. They *must* be scripted as bank employees! They have to keep their jobs so they don't incur astronomical bank charges when they get into difficulty!

OOps I included these in my claim, I'm natwest too, I'll let you know how I get on even though this is another worry added to my putting 2006 when I sent it this year! Doh! I don't think I'm any good at this

Natwest are pathetic. They were arrogant with me at the start of my call to them after an insulting 'offer' letter until I told them I had filed an MCOL claim. Attitude changed completely. Makes them look quite ridiculous.

Apparently the banks are receiving lots of claims from people using third party 'leeches' who claim up to 25% of successful refund fees. Spread the word about Money Saving Expert. I have links to this site on my own web site (can't give anyone the address on this forum though) :(

Hi I have just received a reply from Abbey National to my 1st letter asking for 6 years of charges and although they have sent statements for 1 year they say that any previous years transactions have been archived onto microfiche and they cannot give me a computer printout of this information. They go onto say that arrangements have been made to send me a list of archived transactions. That letter was dated 9th March and I have still not received this list. Ho long should i give them to send this list, my 1st letter to them was dated 26th February.
Also when calculating the charges do i include, failed cheque charge, failed direct debit charge and going over my overdraft charge.
    Any advice appreciated. Thanks

Stick to your 40 days from 26th Feb. I know you can claim for failed cheque & direct debit charges but I'm not sure about the overdraft charge, I'm sure someone will be along shortly to put you straight.

    Good Luck!!
  • Hi not had time to read through whole thread so if somone has answered this already apologies. Sent 1st letter 18/02/07. Got a reply today.

I refer to your recent request for copies of statements on your account to enable you to reconcile your bank charges. Please find enclosed details of charges going back to the date you opened your account, or 1st September 2001, whichever date is most recent. If there are no charges for a certain period then charging details will not be included.

You may now wish to proceed with your claim for reimbursement of charges but, if you do feel you need further statements, this will take longer to access our archived data. Please let me know by returning this letter in the attached pre-paid envelope and I will order them for you.

Under the Data Protection Act, we are allowed up to 40 days to fulfil your request.

The fee of £10 has been taken accordingly.

    I have a few questions
    1. I sent the template letter asking for 6 years of charges so surely its not my problem that some of the statements are archived. Do they have to provide the 6 years I requested within the 40 days they have already had
    2. I am unsure about what they are talking about as the date I opened my account. I have been with them for 22 years. The only thing I think it may be is when they made my account into a select account (Without my permission or signature). Maybe that was around that time. I always mean't to dispute this but it is a little late after all this time
    3. There is supposed to be advice on the site re what you can and can't claim for but I can't find it.

    Any advice greatly appreciated.
