    Natwest wrote to me asking for ten days then a further five days to evaluate my claim. I received a letter from them offering a goodwill refund of £38. Their letter said they did not refund legitimate charges and that the OFT ruling was not retrospective. I called Natwest and told them that the statute of limitations allowed me (by law) six years worth of historical charges. They argued, I told them that a small claim had been filed, they put me on hold and have agreed to take another look at my claim. I gave them the court claim number anyway. Their attitude changed completely. DON'T LET THEM BULLY YOU, they know you'll win.
    My total claim to Natwest is £155 and to Bank of Scotland £115, both including £30 in court costs. I will update as the cheques come in.

    By the time i most likely get the copies/lists (they have 40 days and are probably stalling) the OFT will probably have made their rulings on the 5th April and any claim put in after this date will be for less as the banks will only pay up as to the new rules, and taking them to court will also be more difficult.
    Is there any way to start the ball rolling, IE by just asking for all charges back for the previous 6 years and sending the list in later correspondence when they ask for it, Getting the request logged before 5th april so its in place and an ongoing issue, or will that not matter after that date.

    Stick to the process as it is and avoid getting confused. You need to specify the charges you are reclaiming and the amount and you cannot do this without proof. You must wait for the details or only make part claim based on any proof you already have, not estimates.

    With regard to the OFT ruling in April please read the OFT thread here for more information:

    The OFT ruling will only affect their own involvement in complaints about charges. Court rulings must take on board the law and so will not be affected. Claims can be made as usual before and after the report.
  • Its all a bit scarry but hear goes. Great site. Decided to try to claim for two joint accounts with lloyds. One is older than the other. Sent a letter requesting statements on the 22nd Feb. One account isn't as old as six years so the statements weren't too thick. The other one which has over 6K worth of charges by my calculation was sent missing certain pages. Once id realised that I could find the info on internet banking its amazing how many charges were not sent. Have they breached the Data Protection Act.

    i have sent a letter to diff banks rbs and first direct for list of charges can anyone tell me how long they usually take please the suspence is killing me lol

    If there are charges missing from the details you received as in right from the middle of the page then yes I would say that is a clear breach. Concealing the data is ridiculous but no doubt one of many tricks. If it is batches of statements that may not have arrived yet then no not in that sense but if the 40 day time limit is over then yes.

    You have to allow 40 days for them to get them to you so anytime between now and then really. Twiddling thumbs here too :)

  • Thanks Twinkly. Understood you no probs. The wording of their letter was I may now wish to proceed with a claim for reimbusment of charges, so I dont thinks they will be sending anymore statements. Im not too worried at this stage, but may have to bring it up if it all goes to court.
