EGG - PPI Claim upheld but still no cheque!

With all due respect, arguing over it on the internet is not going to resolve your problem. From what you have said, if you believe legal opinion supports your view, and Egg consider themselves to have acted correctly (and the FOS support that) then your only option as far as I can see is to take legal action (which you say you can't afford).
It does not matter what people say on here, or whether they consider you to be in the right or the wrong - and I'm not entirely sure what you are trying to achieve by posting in multiple threads and continuing the argument.
As I say, as far as I can see you've exhausted the grievance procedures available to you and whether you can afford it or not, it would appear the legal route is now your only option.I am an IFA. Thanks for the advice!!!
Just to make sure,
The situation I have is that ALL of my PPI was removed from my Egg loan in my IVA which is the same amount in the loan debt, OK.
Egg LEFT £ 1,516 of it out of £ 3,797.97 ON THE LOAN DEBT prior to Egg writing it off 5 weeks AFTER my IVA was completed with a completely different amount.
PRIOR to any dividend payment made to Egg, the amounts read as follows:
IVA - Egg AGREED to legally with the courts - £ 7,980.32 after Egg reduced the debt from £ 12,517.29 claimed in 2007 to £ 7,980.32 with the removal of my £ 3,797.97 PPI plus £ 200 compensation and a
£ 34.99 IVA payment made on my behalf by my IVA supervisors.
Egg says it is £ 10,235.32 before any dividend payments.
Only deducting £ 2,281.97 out of £ 3,797.97 PPI when I had a complaint UPHELD by Egg in November 2009 stating that I had a refund of £ 2,020.01 which will be paid to me and reduced in my IVA and LOAN DEBT. I just want to know why I have NOT had this deducted from the loan debt as well as the other £ 234.99 which £ 200 I was awarded by the FOS for Egg to pay me and an EXTRA IVA payment made on my behalf by my IVA supervisors to Egg which never were deducted from the debt PRIOR to Egg writing it off AFTER they agreed a completely different amount 2 days earlier.
That is all. I just want payment from Egg for the MISS SOLD PPI plus every penny they received since April 2010 under the Consumer Credit Act due to FAILING to provide me with my annual statements which they complied to between 2007 and 2010 and NOTHING since.
Egg were legally bound by my IVA until 1 March 2012 to send me these statements by law. They failed to do this and is a BREACH of STATUTORY DUTY. It is as simple as that.
My IVA supervisors AGREED with me saying that Egg had comimtted THEFT and my IVA supervisors have done everything LEGALLY possible.
My IVA debt with Egg were written off on 1 February 2012
Egg wrote off a different amount 5 weeks later after the debt had been CLOSED and CLEARED by the courts.
This is the only thing I say about it. If it is the LEGAL route then I NEED TO TAKE OUT A HUGE LOAN even though I am unemployed with NO MONEY TO MY NAME. Any Ideas?
It is my decision to view my situation on this forum and I just wonder if anyone can help me any other way other than going to the CAB or my IVA supervisors who cannot deal with individual cases like mine after the IVA had been completed. My IVA supervisors were GRANT THORNTON who are a large and well known accounting firm based in London.
Thank you GhIFA for you advice and my MP has taken up this case since November 2011 and it is Egg who are not responding to either him or me upon this matter since that date. It IS their fault entirely that they left part of my MISS SOLD PPI on my loan and I just want it paid back to me as it was left on my loan debt even though my IVA supervisors were paid by Egg. So I had been charged £ 2,020.01 for the removal of my own MISS SOLD PPI do you think it is fair that I paid for this removal and my own compensation and my IVA payment for the second time?0 -
I think you should address your questions to your MP. No one here knows enough about your personal circumstances to comment further.nickybutch123 wrote: »my MP has taken up this case since November 2011

Typing it all out again doesn't aid anything - again, no disrespect, but repeatedly typing your story out on the Internet isn't going to change anything, and won't resolve the situation. It is not a straightforward situation, and we only have one side of it here.
I hope your MP is able to help but the answers are not here on this forum, no matter how many times you tell the story. I wish you luck.I am an IFA. You have all of it and both sides.
My MP has taken up my case but Egg are not responding to
my letter of authority which I stated saying that I have given permission for my MP to act on my behalf.
Egg have refused to respond to all communications I make.
SO far NO LUCK whatsoever.
I am entitled to the remainder of my MISS SOLD PPI which was left on my loan since 7 March 2012 and £ 3,763.82 which Egg received from my IVA under the CCA 2006 due to the failure to provide me with my annual statements I am entitled to under my IVA.
It is as simple as that. The FOS have refused to speak to me.0 -
Looks like it's game over then, especially if you also can't afford to go to court.nickybutch123 wrote: »Egg have refused to respond to all communications I make. The FOS have refused to speak to me.
( Not that court action would necessarily bring about a satisfactory conclusion for you...)0 -
Hello, Can anyone help me?
I have had a letter form a guy called Ian Clark at Egg Canada sq operations in Worthing kindly offering some money with regards to a a complaint I made in 2006.
I did have an egg account/ card and I did complain ( to someone at sometime in the past regards charges for services on an account which I did not ask for nor knew anything about but at the time it was not upheld - I assume it was egg).
I have several questions .....
The letter was sent to an old address and is requesting proof of address to be issued before we can progress, fair enough but I was worried about sending this data off if the letter is not genuine. From the forum poor Ian seems to pop up a lot and the address seems ok, so is this for real? Shall I go ahead?
The other is are the offers realistic? I cannot remember the details of the loan / card a the time but am being offered nearly £250. Should I try and get more or ask how this is being calculated before I say yes please?
Thanks0 -
You can ask how it's calculated yes, but unless you have your own records you can't check. To check yourself, send them a SAR and £10.
It's up to you whether you go ahead or not isn't it but i wouldn't be saying no.Non me fac calcitrare tuum culi0 -

I am at a complete what to do I am going out of the country and if the send the cheque now I would rather it went to my parents address so I knew it was safe til I return.
Please any help or advice would be appreciated.

Hi Loopy_lols, I just wondered if you'd had any joy yet with Egg? We are waiting for ours too... Signed our letter 1st April and nothing from them since... What email address did you use to try and get contact?
I'm writing yet another letter to Egg today and sending recorded!
Hope yours turns up soon!
