EGG - PPI Claim upheld but still no cheque!

    The original letter was from egg back in Dec 2009, it should be still on Canada Sqaure Operations system as they stated they had sent me a letter back then.

    I've asked my wife to forward me the PPI company details, but I have never had any dealings or contact from any PPI company.

    ...also the PPI company says that if they do not receive a reply from me within 14 days, they will take it as aknowledgement that I WANT to go ahead, meaning I receive the money and pay them 25%. I work at sea and I am away for the next two weeks, so how can they twist my arm. I have my seamans discharge book to prove it.

    I was told not to go ahead and not to cash the cheque. That way, I can apply directly to egg with no middleman.

    It sounds as if you did employ a company to complain about your PPI....if they have your signature on a contract, or a verbal contract, you are stuffed, they will want their cut and take you to court if you don't pay.

    If Egg wrote to you in 2009 to say you might have been missold, you may be timebarred form complaining again anyway.

    I cant remember, but must have done so employing a PPI company was a ong time ago. I thought if the decision from egg, as sent in the letter in Dec 2009, says I am not entitled to anything, then its case closed. Since then I never bothered claiming for PPI refund.

    This must mean that this PPI reclaim company must still have been trying to get my money back after the decision from egg, but I have not had any correspondence from them ever. Then out of the blue I get the letter from egg saying I am entitled.

    So, if they do want their cut, how can I pay when I havent recieved the cheque from egg yet?! Not easy as Im working away, but they keep sending letters saying I need to pay them!

    Has anyone had or got this problem .
    i recently got my case upheld from canada square operations for a previous egg loan , they were pretty quick and efficent i signed the acceptance form and returned it got a letter back 2 weeks later saying thanks for returning your form your cheque will be issued within 20 working days . ( this was 14th febuary )
    STILL NO CHEQUE ( 9 april )
    should of ben paid by 14th march .
    wrote them a letter 2 weeks ago as there are no phone numbers to contact them on any of there letters they have sent me .
    still had no reply from them whats going on ?
    anyone else had or got this problem ? anyone got a contact number for them ?
    what should i do next ? write again but get my letter registerd delivery ?
    or wait a bit longer before going to ombudsman which is crazy why dont they just issue me the cheque and be done with it .

  • Hello there, I have a situation with Egg also regarding PPI claim but it is a very long story of which is ended up with Egg owing me £ 10,235.32 since 7 March 2012 when THEY WROTE OFF MY LOAN DEBT which a MONTH EARLIER WAS WRITTEN OFF by the courts under the IVA rules.
    Egg was one of my CREDITORS within my IVA between 2007 and March 2012. In 2009 I had a PPI claim UPHELD which Egg paid into my IVA
    £ 2,020.01 from my PPI but the thing is that IT WAS NEVER REDUCED IN MY LOAN DEBT and in 2011 I had a FOS FINAL DECISION issued which ORDERED Egg to pay the rest of my PPI into my IVA and reduce it in my LOAN DEBT which they did and also paid £ 200 compensation into my IVA - AGAIN THIS WAS NEVER REDUCED IN MY LOAN DEBT as well as an IVA payment made on my behalf by my IVA supervisors and the same thing happened - NOT REDUCED IN MY LOAN DEBT.
    In other words, Egg owes me £ 2,020.01 from my MISS SOLD PPI which they WROTE OFF on 7 March 2012 AFTER my IVA was CLOSED, CLEARED and WRITTEN OFF by the courts a MONTH EARLIER.
    At the end of February 2012, Egg sent details including the MISS SOLD PPI and compensation onto the FOS who issued a decision in July 2012 showing that THEY MADE ADJUSTMENTS REFLECTING REFUNDS OF MY PPI PREMIUMS - what a load of rubbish!!!!!!
    Egg Banking Plc had STOLEN and LIED to me and now the FOS and Egg are REFUSING TO COMMUNICATE WITH ME AND REFUSING TO DEAL WITH ANY COMPLAINT OF MINE.
    THEY OWE ME THE MONEY which now includes £ 3,763.82 they REDUCED between 5 March 2012 and 7 March 2012 from a CLOSED LOAN DEBT due to FAILING TO PROVIDE ME WITH MY ANNUAL STATEMENTS COVERING
    27 SEPTEMBER 2009 - 1 MARCH 2012 which by law I am fully entitled to receive. Under Section 77A & 77B of the CCA 2006, I am entitled to receive all money that Egg received from me since April 2010 when they went into NON COMPLIANCE.

    I would like any help possible in claiming my PPI back when it was paid into my IVA in full but NOT TAKEN OFF MY LOAN DEBT which they should have done in the first place PRIOR to Egg WRITING IT OFF after my IVA was completed also when Egg or the FOS refusing to respond or deal with my complaint whatsoever?
    I cannot afford to take them to court - I have NO MONEY.
    Who can I turn to for help when I cannot afford to take them to court?
    I desperately need this money and it is £ 10,235.32.
    Egg committed FRAUD & THEFT since 7 March 2012 and they are denying everything. I never received any information about the takeover or the closure of Egg whatsoever. NO INFORMATION was sent to me.

  • Hello again,
    If my last message was confusing, I will now clarify in a simple way.
    July 2006 - Obtained Egg loan of £ 8,901 with Egg adding £ 3,797.97 PPI.
    Loan repayments totalled £ 181.68 PRIOR to entering IVA in March 2007.

    2009 - PPI complaint UPHELD £ 1516 PPI plus £ 504.01 interest reduced in IVA - NOTHING REDUCED in LOAN ACCOUNT.
    2011 - FOS complaint with Egg ORDERED to reduce £ 2,281.97 in my IVA and LOAN DEBT and pay me £ 200 compensation. £ 200 & £ 2,281.97 was REDUCED IN IVA - ONLY £ 2,281.97 was reduced in LOAN DEBT.
    2011 - My IVA supervisors paid Egg £ 34.99 on my behalf but this was NEVER REDUCED IN LOAN DEBT.
    IVA dividend payments totalled £ 3,763.82 which was reduced in my IVA and my loan debt even though THIS WAS NOT THE CORRECT AMOUNT IN MY LOAN DEBT.
    The HIGH COURT wrote off my IVA and Egg's loan debt of £ 7,980.32 on
    1 February 2012.
    Egg wrote off £ 6,471.50 AFTER reducing this with £ 3,763.82 on 7 March 2012. Egg said that EVERYTHING WAS DONE CORRECTLY AND THEY OWE ME NOTHING WHATSOEVER AND THIS COMPLAINT IS NOW CLOSED AND ALL MY RESPONSES WILL BE NOTED BY NOT REPLIED TO.
    The FOS are not even replying to me even though they agreed with Egg.
    Put this simply
    Loan debt £ 12,517.29 minus PPI refund (£ 2,020.01) minus COMPENSATION (£ 200) minus IVA extra payment (£ 34.99) equals £ 7,980.32 and this was agreed by Egg and written off by the courts on 1 February 2012.
    According to Egg it is £ 12,517.29 minus PPI £ 2,281.97 equals £ 10,253.32 which was written off on 7 March 2012.

    Now do you understand that Egg owes me at least £ 2,020.01 from my MISS SOLD PPI and they have done NOTHING in putting it right.
    They also owe me £ 3,763.82 since April 2010 due to failing to provide me with my annual statements which under the Consumer Credit Act, I am entitled to have ON REQUEST AT ANY TIME. The FOS & Egg have refused to send me my statements which is an ACTIONABLE BREACH OF STATUTORY DUTY.
    Again, I cannot afford to take them to court so please any help would be great.

    You're still not making any sense.

    The amount you paid in PPI [which you didn't pay at all] is still a lot less than the debt that was written off.
    As such, they owe you no money and you are completely mistaken.

    They also owe you nothing with regards to statements. If you want your statements, send them £10 and a SAR.


    Your circumstances of borrowing money for a loan have nothing to do with the CCA which is for "all those who use credit to buy goods and or services, for example, on hire-purchase agreements or using a store credit card"

    Hiya

    Just wondered if someone could tell me what I need to do to chase my cheque for over £4.5k that I was offered in November last year. I responded to the letter from Canada Square accepting their offer and providing them with details that they had requested within the offer and I have heard nothing back. I have e-mailed them a number of times and tried calling but whenever I get through the department that answers isn't the correct department and they are unable to put me through :mad:.

    Should I write to them and send the letter Special Delivery, if so is there something that I should be 'threatening' to do if they do not respond or should I just sit tight and wait?

    Haxeybird - I had the same issue with Egg in January. I finally got my cheque in early February (my cheque was approved in October).

    I was told my first cheque had been sent to the issuing department and then got cancelled for an unknown reason. I then had to wait a further 4 weeks for another one. By this stage I was livid having kept calling them and emailing so I wrote to the Worthing address outlining the issues I'd had and that they hadn't kept to the timescales promised. I received my cheque less than a week later so definitely worth writing!

    I did tell them in my letter that it's very frustrating that in this day and age you can't communicate with them effectively by email or phone and that you have to resort to snail mail!

    All the best with your cheque. Just remember it's worth it in the end!
