    Natalie, i feel for you. I'm in the same situation (one of mine is Extra Special too)......although in my case apparently my £44 a week is *millions* :rotfl:And she wants that reduced. (Tuff Poo)

    Is your case on Old Rules? I'm guessing so.
    So you've got 2 choices.

    1. Leave it as it is (and take the moral high ground)

    Or 2. Look at the online calculator on the csa website. Work out how much he would pay on CSA2 . If it's more......you'll have to close your old rules case, wait 13 (i think) weeks & then open a new case.

    Downside of that is you won't get any money for the 13 weekis.

    Sadly, IF he chooses to quit his job to avoid csa...practically theres not much you can do.......I have my own word for folk that do that but the filter blocks it:o

    Are you on CSA 1 or 2...? I am guessing CSA 2 as it is dropped by amounts in percentage.

    How it is worked, is his new partner is irrelevant as far as income is concerned, she could earn a million a year and it would still be reduced on CSA 2.

    They would take his income, reduce it by 15% for 1 child, 20% for 2 children and 25% for 3 or more children. And then you would be assessed for payments at 20% of the remaining income. His mortgage and who is paying it is completely irrelevant.

    I'll work on assumptions and figures you give.

    if you where receiving £150 a week for 2 children then it is £650 a month for CSA being 20% of his entire income before they got together... 20% would mean his take home pay is £3250 a month. Give or take a few pounds. And again this is going from your original post...!

    So what the new assessment should be using CSA 2 deductions and workings. it would be 25% of £3250 deducted leaving £2437.50 to be used for your assessment. and you would receive 20% for 2 children of that.

    The end result should be £122.50 a week or £487.50 a month.

    The only other reductions he could possibly get would be for travel to see the children. And possibly upping his pension contributions, but unlikely probably.

    My answer to you, is take the figures worked here, call the CSA and suggest that if his income is the same, or higher, or lower, that they reassess to a correct amount, and that they include any and all WTC and CTC (although they probably don't qualify on his income). And if the result is still the same that they raise a complaint on your behalf...!

    As for getting out of your cot ;) and having a go, understandable, but look at the amoutn of posts people make, look at how many times they have been thanked, and read some of the other posts they have commented on, you will soon learn who to ignore and who is helpful. It is like most forums, and you come here for help and came across with a chip on your shoulder. I understand it is not about the money but the principle, but there are many many people on here who have fought for years and don't get a penny, and even when assessed they wait years and still have nothing. So to get help, think before you write... ;)

    I hope you get it sorted and don't stay bitter, you are in a much better situation than most and the kids learn by there parents action. And that will lead to them making there own decisions about there father and that might shock him in the future...!

    I understand but it was the same person that asked about benefits so I thought the tone was already quite nasty, plus he hasn't actually said otherwise that the intent of that question wasnt anything but a little dig so I still assume that the question was asked horribly! If you for example had simply asked if I received benefits I would have answered no, but the posters intention was snide!

    Hope all goes well for you and yours, I have to say though that your ex won't be completely innocent. It's easy just to blame her but............

    I would point out that a lot of people take exception when new kids and new partners kids are taken into the equation.

    You cannot look at like that, but if my figures are accurate from the info you give, the figures are very simple.

    You SHOULD of had your CSA reduced by £27.50 a week.

    You have 2 children and receive £122.50.

    So the long and short of it is your children are worth £61.75 each according to the CSA and the ex's (hers and theirs) are worth £9.17 each by way of a reduction.

    Bear in mind that is with the correct figures working out from your original post about his income, getting 3 times more etc etc etc...

    Makes you think about how much there kids are worth doesn't it....! But it is deemed to be the best way to currently work things, and while the calculations will change in the future on CSA 3 it remains the same basis...

I do apologise about my first few posts:embarasse was a bad time to post and a shame the first reply to me wasn't from you otherwise I probably would have come off slightly better and not so angry!
    I'm not bitter, this has all really just blown up today so still fresh! I have calmed now ;)
    I know my ex is to blame! But I truly believe he is being led by his new partner because this isn't the man I knew before! He was quite happy to pay for his kids but things have clearly changed! I thought I was on csa1 but I don't know? How do I find that out?

    There is nothing stopping you from doing that, but i don't understand how you can be on CSA 1 unless the case was opened before 2003. If that is the case. Then it is a lot harder to work out and there are many variables to include.

    However, at the same time, the CSA can include her wages for assessment purpose and assume her income is used to pay mortgage etc. In effect sometimes leaving more money for assessing...! They would have to request her income details, which i believe she has a right to refuse, but they can still make assumptions.

    The real thing you need to clarify is WHEN the case was opened, then we can go from there...

    I'm on csa1 case number starts with 103. 2003 the case was opened then! I thought it had only been 6 or 7 years! God time flys, old age creeping up on me! :) so its definitely csa1 does that make it completely different? Thank you for all your help!

    Have you applied for a departure based on housing costs?

    I don't understand why there's a percentage reduction for new children if it's on CS1.As I understand it there is an addition to the nrps protected income but if the partner has an income it may not be the full amount allowed to him.Get googling too as I found info on here regarding that.
