    Small Claims Court judgements do not set a precedence, although they can be used as supporting evidence in any related claims. I believe that only Crown Court and higher are able to set precedences.

    My original 'free for life' contract was on a £30 pm phone deal for my wife.
    When she stopped working and renewal day came, we asked to reduce mins to £15 pm and to forgo the free bb. After calling a supervisor, it was decided to allow continuation of free bb as before. A week later, we had a call to say 'a mistake had been made, and that we needed to have a least a£25 phone contract. Explained loads of mins not now required & said we were considering changing to BT for bb. Customer Service person told us to forget the call and continue as before.
    Last year had a call saying 'free broadband was ending unless we upgraded and paid more'. Again refused and told forget the call, it was over zealous salesperson, everything would remain as before.
    Now almost a year later we are here, with the threat 'give us more money or we cut you off'.
    Anyone else fancy renewing with this outfit.
    My intention is to grab all I can and make for the exit.

    Please feel free to use any of this in your fight for refund

    Nope. It's available to any customer that was miss sold their mobile contract on the premise of free broadband is guaranteed as Eva I think said and I quoted. Or at least that's what I've been informed of yesterday and there has been no updates since from management.

    I represent the BB team yeah, but I'm not sure what you mean. It was a long day today! :-p

  • Well, it has been an interesting day. Call back received from Exec Office as I was about to leave work. Now agreed to penalty free cancellation of my wifes contract, but sadly not mine - although we agreed to sign up together, the BB was attached to her mobile contract only, so nothing they can do for me (TBH, I agree with that assessment). I asked if this meant that they would compensate for hassle, and for the £25 court costs incurred, and got a brisk "no, it was her choice!"

    Arrived home to be met by smiling wife, who had received letter from legal team, offering an out of court settlement - penalty free release (for her only) PLUS court costs and £25 towards our admin expenses...postage, photocopying etc.

    Giffgaff SIM now on order, PAC code safely noted, and will be withdrawing court action in a couple of minutes. Shame that I am still tied up for another few months, but the house is moving one step closer to being an orange free zone - after around 20 years all told.

    I'll be keeping an eye on the forum, and will continue to post as apprepriate, and support others wherever I can.

    Keep the faith all - I'm off to start a new batch of homebrew to celebrate :beer:
