Take a look at Section 3 http://www.companieshouse.gov.uk/about/pdf/gbf3.pdf the Act applies to sole traders who are not trading in their own name
Direct quote: The Business Names Act 1985 requires any person carrying on business, whether or not incorporated, to:

obtain the Secretary of State's approval before carrying on business
using any of the words listed in Appendices A and B;
•
ensure the use of any of the words listed in Appendix C does not
constitute a criminal offence; and
•
make certain information available to others about the ownership of
the business.
Sole traders do have to display an address on their websites. See page 9 of the attached guidance

If you're selling stuff from a website to consumers, the Distance Selling Regulations apply no matter how smalll or big you are. The DSRs require you to provide a full geographic postal address (a PO Box is not good enough). see 3.1

I spoke to the bank who also advised me to report to the police via Action Fraud. CAB also advise this on their website.

because shes not answering letters does not mean shes no longer at that address, just means shes chosen not to answer mail.
But that fact is that her business chairandsofacovers.co.uk that shes still seems to be trading as it listed at that address, so yes we know her name and what business she is using, but alarms bells ring as her ltd company reg at the same address folded0 -

Has anyone else not received a refund or goods and reported this to the Police?
I have still been getting a couple of emails each week from Libby at chairandsofacovers.co.UK stating she has posted my cheque and she can't understand why it hasn't been delivered....
Last week she said she wanted my bank account details to transfer back the money but I told her how ridiculous that was. I have told her that I have made a Police report and that her company are defrauding people but she totally ignores these comments and continues to say she has sent the cheque.

I have had no joy getting a refund, she doesn't even respond to my emails!!! Really infuriating. I've just accepted I won't be seeing that money again. I have reported them to the Police Action Fraud though, although I don't know if anything will come of this. Maybe if a few more people report them as well we might have more of a chance. They can't be allowed to continue. Think of all the poor people who haven't discovered this forum!

Thanks annavdf. Sorry you're in the same situation as me.
Just had another email from her this morning saying that the latest 2 cheques she supposedly sent got lost and she cancelled them... So once again she wants my bank details.
Don't worry I have no intention of giving her them but I guess that no amount of asking is going to get this money back. I lost £240, how much has she stolen from you?
I wonder if I should have waited (the huge amount of time that it takes) to maybe receive the covers I ordered, as some people have clearly got something tangible out of the company in the past. If they were not the right size etc. I would have something to put on eBay. This way I have nothing but anger and frustration.
Do you think we could take her to Small Claims Court or is this considered a criminal case now rather than civil? Any advice gratefully received please, I can't just give up.0 -
Let take them to court.
You can prevent online fraud by collecting as much info as you can. While more information on your clients is generally better, there is such a thing, as collecting too much info.0
