Take the case to the financial ombudsman instead they can deal with claims up to 100K0

Hi
Ive just finished the first process of claiming bank charges back on behalf of my mam, but the claim including intrest is over £7000. Ive heard of a few people winning back their charges, but not on this kind of scale. Would it be advisable to claim less than £5000, or just go straight in for the £7000?
Also, do you have to send the statements and letter to your local branch, or national HQ or whatever it is?
Any help much appreciated, Oly :beer:0 -
First of all the amount doesn't really come into play until such times as you may have to start court action so send off your claim now.
Do a list/spreadsheet of the charges, use Martin's Interest Calculator don't send in the statements, you need to keep these safe and you can send to either your local branch or head office. Check out the Reclaim Help Thread which is linked in my signature for the address and lots of useful information.
As regards the size of your claim there is the option of using the Financial Ombudsman for a large claim, have a read of Martin's article, or indeed it depends on which bank you are claiming from so find the bank thread that is relevant to you and read of other users' experiences and also check out the Success Stories.0 -
I have just completed a claim for £8430 and won through the court. Start your claim as Martin suggests and go through Northampton online court but before submitting make sure all the details are absolutely correct as any errors will force you out of the online process and into a lot more paperwork. The court costs will be higher - £250 - and they will pass you to the appropriate court if it comes to that. It will be local to you.
Read every document sent by the court carefully as one of mine had errors that I asked to be clarified. The bank misread and ignored the documents response time so lost the case. If you have any questions ask the courts as both Northampton and my local court were very helpful. It is not as quick as people think but it can happen.
Note the bank may say the case is stopped pending the ruling of the test case but ignore that and only take the advice of the courts as it is up to them if your case continues. Also watch all dates and act within or immediately following as it keeps the process flowing.
Good luck and be patient. :cool:0
