    The courts service will allocate your case to the appropriate track.

    You need to be aware that if it gets moved to the Fast Track, should you lose, you may be eligible for some of the defendants costs.

    In reality, it's very unlikely the bank would go as far as a courtroom and even less chance you would lose.
  • I have just worked out how much i am owed and it comes in at over £6,000.

    I have read that you can only go to the small claims with under £5,000 so in that case what should i do???

    Can anybody help me please?

    hi. if your claim is under 5000 before interest then u can still go to small claims.depends wot situation u are in whether u want to do this by reducing your claim.if not then we are in the same situation cos i'm in the process of trying to claim 8500 and have just sent a letter saying that i will take them to my local crown court.i'm still a bit unsure of the process but there are some good links on this site for advice try rex's thread or go to MCOL site and you should find some advice there.

    A while back (before I discovered this site/forum) I started proceedings against Abbey. Although the total was nearly £7,000 in charges over the last six years, I heard it was better to make two separate claims (under £5,000 each) as this would mean both being handled by the small claims court. I was told that these should not be run concurrently as it could hinder the process. Is this correct?

    I have so far only filed one case for the maximum £5,000 with the other to follow when this has been satisfactorily resolved. Is there much point in me hanging on to file the second case? I have just completed the AQ for case 1 and expect to hear back shortly concerning a court date.

    Anyone been through a similar scenario?
  • HI could any1 recommend the best way to claim around 6k 8 with interest? I've sent all steps and just about to make a claim with mcol, but didn't know whether to do break it down?
