  • hi there can anyone help us we are claming just under £9k plus intrest from nationwide we have a copy of carges from last six years. is there anybody out there trying to claim this amount, or has anyone done so and won.

    i am in early stages of reclaiming MY money from RBS, just recieved statements and i was sickened to discover they have taken 6k+ over the last 4 years!! with interest the total is 7k+.

    my idea was to ask for the full amount including interest then depending on their reply i was going to make an offer to settle at 6k if they settle out of court, if not take them for the whole lot plus court costs plus loss of earnings....

    is what i am thinking of doing the right idea??
    i dont want to make a stupid mistake and i want as much of the money back as possible

    any advise anyone??

    Thanks Karen. Your way of going about it seems like the right thing to do. My concern is that I have claimed probably 75% (£5K) of the total charges I believe are due to me so far with no interest calculated, up to the point of the AQ. I intend to settle this claim with Abbey then start a further claim for the remaining 25%.

    Three questions:

    1) Do I wait until claim #1 is resloved before submitting claim #2?

    2) Can I try and add the 8% statutory interest at this late stage?

    3) Would a court look unfavourably on me if I tried to make a claim for interest only at a later date? i.e. the full interest due on all 100% as part of claim #2 or as a 3rd separate claim?


    As you can imagine, I am hopefully close to resolving the first claim, so any help would be appreciated at this point.

    You need to understand the 8 % interest that you are claiming. This is awarded by the court on any claim (it could be a claim on any company not just bank charges) when you reach that stage, its not something that you can go back and claim as a separate claim.     could you split down into two claims? Years 1-3 and Years 4-6 for example?

  • Okay my claim from Nationwide is £8226 with the Court fee added... thats not counting the interest.

    I have filled in the MCOL forms and they are sat saved ready to send off.

    I know that people have followed Martins advice if they have claimed over £5k and they have paid out or should I just cut this down the middle but file two claims at the same time?

    Any advice greatly received.

    I know it will go Fast Track instead of Small Claims Track so I am not unduly worried but knowing what Nationwide are like I dont want to be kicking my heels

    on charges over £5000 as a small claims court would
    not be applicable.

    New and very anxious. We have calculated a return of charges to the amount of 11.000.00 excluding interest. What do we do now this means we cant go to a small claims court?
    This is what we have estimated , given the info we have been sent.
    Any advice would be welcome as I dont know if I can cope with this. GRRRR.

    I am trying to find out the accurate info today as my claim is almost £8000 and nearer £ 10 with interest .Couldn't beleive it .
    I have filed with MCOL and I know it will be 'fast track' rather than small claims
    I was under the impression that it is the same process,the only difference being that if I lose then I have to pay their legal costs Inthe smallclaimsyou do not . I decided to risk it as no one has lost yet and that chap was offerred £36000 even that amount settled pre court
    if I find outtoday then I will post.
