    I am currently trying to take my bank to court, i sent the first letter back in January and up until a couple of weeks ago had heard nothing until I sent the letter threatening court, they have sent me a letter saying the charges were lawful and that they would not be refunding them. my charges add up to about £5500.00 and £6670.00 with interest, I have tried to make a claim through the online money claim on this site but am just really dubious the fact that they advise anything over £5000.00 will not be handled in a "small claims" court and there is a court fee of £250.00 which I don't mind paying but do you think I should reduce my charges to under £5000.00. What happens when your charges are over??

    I do feel a bit greedy but bearing in mind my bank are still charging me every month and I haven't added it on to the total amount.

    I am really worried that I am getting in a bit deep. If anybody could offer me any advice I would really appreciate it as I would like to get this sorted as soon as possible one way or another.

  • Hello,i am going through claiming my charges for the first time and am unsure as to what happens next.
    I have sent in my letter to request my charges back and been told i am not getting them(surprise surprise!),but where do i go from now?my total of charges is £5339 including interest but from what i am led to believe the small claims court only deals with up to £5000,so where do i take my claim to now?

    Details on this should be on the MCOL website.

    However, you may find it easier to reduce the amount you claim through the court to under the £5000 mark. That way it can be heard under the small claims track. (Should not be liable for the defences costs if you lose).

    Just an idea.

    I am in the process of claiming back the fees from Nationwide. I am at the stage of submitting the county court claim. However i am not sure what to do as the fees excluding the interest is £5495, with interest of over £1200.

    Do i just reduce the amount i am claiming to £5000? Im not sure how the interest would work on this! or is their another route?

    Any help would be great!

    For claims over £5000, it might be an idea to try and find a solicitor to take on your case, possibly on a "no win no fee" basis.
    The acquisition of wealth is no longer the driving force in my life. :)

    HI

    i have taken HSBC to court for in total with interest £7100

    I have now got to the point where the bank have defended the case so i am waiting for a court date .

    Beacause my claim is over £5000 if i lose i will be liable for the banks cost at court. But i look at it as if i do lose then i will pay but it will be on my terms (ie £10 a week) but if i win then i will be over the moon

    Again, I'll say there is no such thing as "no win, no fee" there is always small print. :)

    It depends if your claim can still be allocated to Small Claims which is quite likely with the OP. If you hang on I'll pop this into the thread discussing high claims.
  • I am about to put in the paperwork with the courts to claim against natwest.

    My total before interest is a little under £7K.

    You mention that fees (should i lose) could be quite considerable, does anyone have any idea what "quite considerable" could equate to.

    I have just got myself debt free and it is time to try to get some pennies back from the people that helped to increase my debt problems at the time. Obviously if i were to be stung for a big fat court bill I could be back to square one...

    I currently have a none banking claim in at MCOL for over £7,000 and its fine. Claims upto £15,000 incure £250 court fee.

    I also remember the guy that claimed £24,000+ used the MCOL website to register his claim. His total claim was £35,987.94 with 8% interest :)

    You could always split your claim into periods, say 2001-2003 and 2004-2007 or how ever best suits your claim ;)
