Why not? I would like to know how Android is developed and distributed to manufacturers, it might help me to understand your point of view.
Google develop Android, when they have a release candidate they then open source the code. You are then free to do with it what you want. Manufacturers then do exactly that, that is why Samsung are responsible for updating Samsung phones; HTC are responsible for HTC phone and so on. Not google.Don't Google own and control important parts (Play Store, location services etc) of Android though?
Yes and if you want those things on your Android device you licence them from google and have to meet certain criteria dictated by google, or just hack it.0 -

Where do you download the open source code from for Android 4.1 without Google licence?
Send the link so all of us can see the download link. I am sure as per your post the people who own Linux or Gogole must have a link to download the Android 4.1 since as you put it "Open Source"
If it is open source then anyone can download the source code, this is the whole point without Google stuff and you should be able to send the download link for Android 4.1, am I right?
Why Google only release the code to some manufacture who work with Google such as Samsung and HTC. If this is the case then it is not open is it? With the open source everyone should be able to down load and access to Android 4.1 not selected few companies.0 -

That was a developer release/preview the source code will eventually be released to the public.
This whole debate is just getting childish, people should state facts and not their opinions in order to give people clear information.
Reasons why Microsoft managed to update all windows phones was
that they have standardised most aspects of Windows phones such as hardware & software and manufacturers/carriers cant mess around with it much.
So when it came to updating them it was quite simple as they are all the same.
Android OS is different, works on phones of various sizes & hardware. Manufacturers/carriers can do a lot of customization.
Which causes a problem when updating.
Google cant update 3rd party phones but its own Nexus line gets updates. The Nexus line of phones are actually developer phones
meaning manufacturers should use it a template for their phones but hardly any do.
if you want the latest & greatest then you got to hope your manufacturer decides to update the phone and if your even more unlucky and have a carrier custom rom then you might have to wait even further.
The open source nature of android allows people who are desperate for an update to do this. Its not simple but its do able. So at least you have the choice.0 -

Yes you can download the source code, you'll need to be a developer, because 4.1 hasn't been officially released.

4.1 has been released to developers and therefore is available and to more than just a few manufacturers, its even been ported to the Galaxy S a device that samsung stopped supporting passed 2.3.

What you have sent is the code to make apps not the Android OS versions to download. I know everyone can make apps for Android, this is how malware get in.0
