    I have an appeal against a parking ticket awaiting review by an adjudicator. The council who issued the parking ticket have got my name wrong on their evidence summary, can I use this as leverage for a win in my favour?

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • I'd just like to say a big thank you for your advice on the forum.


    Like others, I received a PCN for leaving the site a couple of months ago. My initial instinct was to ignore any letters but I read your forum advice and used the template - modified for the circumstances, and complained to two of the shops that I had receipts for.


    I was surprised when they sent a 'Final Reminder' instead of a POPLA reference, but I simply sent a copy letter, re-iterated that I wasn't going to pay and asked for the POPLA reference.


    As you promised, they caved in and 'on this occasion' have decided not to pursue the matter further.


    Shame really, I was starting to look forward to a day in court!

    It's not so much 'my day in court', (where, by the way, the result is far from a foregone conclusion), but the weeks of paper-hassle leading up to court appearance, the research of legal and technical issues and, even more importantly, the preparation for, and understanding of the same and the ability to articulate it in person against, often, a lawyer trained in the law and adversarial techniques, in order to persuade a Judge of your case.

    Standing there 'telling the story' (mitigation) and complaining about how unfairly you have been treated will be a foregone conclusion, however - a CCJ against you.

    A much better, and all but guaranteed successful approach is via initial appeal to the PPC, followed by one to POPLA, with most of the work done for posters as detailed in the NEWBIES thread.

    More than one way to skin a cat, but POPLA is the easiest (with forum advice).

    Note to ReginaldP - my comments aren't personally directed at you, more intended as a heads up to NEWBIES who might think a day with a Judge is an easy option.

    I have received a rejection from the London Borough of Newham to my appeal against a parking fine, and been told I cannot appeal to PATAS as I have paid the fine - I sent the cheque in good faith in case my letter was lost and the fine doubled.
    My letter to Newham stated:
    " I parked my car in Grove Crescent Road E15 after 5.30 pm and went to pay at the meter located near St Francis Church Car Park. I inserted two pounds for one hour’s parking but no ticket was issued and I could not retrieve my money. I left a notice on the dashboard stating: “5.42 pm I put £2 in the machine – pressed green button and nothing happened.” I was therefore surprised on my return to find the Penalty Charge.
    When the parking meter is emptied you will find at least £2 in excess of the number of parking tickets issued, which will verify my appeal.
    I would like to seek your advice as to what action I must take in future if the same thing happens and a machine is not working? Do I pay again at another machine, thus doubling the amount I pay to park my car? What if that machine withholds my money also and does not issue a parking ticket?
    I attach a cheque in good faith, but anticipate it being returned on the success of this appeal."

    I have received a generic reply from LBN turning down the appeal. They state:
    1. There were no faults with the machine.
    2. If the machine was faulty I should have parked elsewhere
    Do I have a case to take this further?

    Looks like PE trolls winding people up and wasting every bodies time.
  • I received a parking ticket a few days ago when my daughter gave me a call to ask if I could pick her up as she had just bought a new coffee table and (obviously) could not manage a 20 minute walk home with it. The shop she bought it from has no specific parking and all the surrounding roads were busy (including double yellows). However across the road is a co-op car park (managed by smart parking), there was no one around (official) and as my daughter had already bought it and was waiting for me, I parked in a space and literally went across the road to help her carry the table out. We were no longer than 5 minutes and on our return we were being issued a ticket. When we got to the ticket man he hadn't even printed/issued the ticket and although we had clearly returned to leave with the car he continued to fill in the details and print the ticket (despite claims he had already printed it, it was quite clear he hadn't when he printed it out in front of us). The ticket was for £45 within the first 14 days and £90 thereafter. Firstly I cannot even afford this ticket and secondly I find this an unfair situation but wasn't sure whether it was good enough grounds to appeal on, if anyone could suggest whether it would be a good idea to appeal please respond!!
