I did think, in fact I asked one of my sons who is a Lawyer and that is the advice he gave. So, it seems my contribution is very much more credible than yours.;)

Who are you to say the OP bought a fake? Who are you to say that any other poster should not spend their own hard earned cash as they see fit?

Regardless of what notices they display they still have a legal duty of care, your disparaging that does not change the situation.

my dads bigger than your dad

    i consulted my common sense

dont go in to get dye put on you in posh stuff

    even you should understand this

as i said the duty of care is there they will have done a risk assessement and as such offered £100 purely as a gesture of goodwill
if i was the salon owner i would see any lawyer in the country argue that one and im confident that the other party would lose

You are not particularly articulate;) so forgive me if I would rather take advice from someone actually qualified to give it.

You really have no idea, so it is simply pointless to debate the issue. Dream on.

Firstly you do not need a solicitor, secondly the OP has a right to get the details of the Public Liability Insurance details of the Salonand file a claim. Infact the PLI certificate legally must be displayed in a place where it canbee seen by the public.

The OP can raise a claim(no need for small claims) and the Insurance company will deal with the OP and decide on the value of the second hand bag and offer a compensation. If the OP pushes the salon owner I am sure they will offer an amount as high as their excess as if there is a claim they would have to pay teh excess anyway and incur higher premiums next year.

At my previous employer over a 7 year period we settled such matters out of the insurance as it did not make sense having them claim on insurance incresaing our costs. all three teimes we offered 1/3rd our excess and twice the customer accepted it the third time we had to offer the whole excess and thankfully the customer accepted.

I think it is human nature to make allowances for those you believe are usually on the same wavelength as you.

However, if I disagree with someone I say so regardless of any affinity I may previously have felt. Perhaps I may couch it less confrontationally than I would with those I have had previous issues with, but I will always give my view regardless of who may agree or disagree.

is it warm in here or is it all this hot air

im not debating with you as you seem to be a master of debate

ive said my bit to which i am entitled

    you dream on

They don't have a right to demand details of their Public Liability.

Public Liability is not compulsory, thus there is no certificate to display, I think you may be confusing it with Employers Liability
  • Hi, Can any one please advise, I registered for a new FairFx card in early May and £100 was taken from my Halifax account on the 13th May and converted to euros on the card. The card was never delivered. I e/mailed them in early June and they said it must have been lost in the post and promised I'd have another one in 3 - 5 days. Still no card has arrived. I've e/mailed them again but no reply yet. This is getting ridiculous at approx 6 weeks without a card.
Hopefully someone can advise what I should do, Thanks

It is, of course, your prerogative to comment, and also the prerogative of others to sort the wheat from the chaff, or, put another way, the good advice from the not so good.;)

It is obvious for all to see which direction the former lies. Enjoy your evening.

I think you should start a separate post about your query, this one is about hair dye on a very expensive handbag :D

    Hi All,

well i have only just come on and seen all my replies! Wow, i never thought would get so much response!

Firstly sorry for putting in the wrong place, i didnt realise till afterwards i had posted in credit cards section but wasnt really sure where to move it too! there should just be a 'help' section :)

just to cover a couple of points, the bag was a lot of money, but it was something i really wanted and i saved for ages for it. i shouldnt really be made to feel silly for spending a lot on a bag. i take a lot of pride in my appearance and what i wear. i am happy to wear primark clothes but my Paul Smith bag for example will last me for ages, like it has the 2 years it has already! the £20 bags wont, so i would rather spend a large amount to last a while as over the years you wouldnt spend far off that if you brought cheap ones over and over again. This is how i have always seen, you buy quality.

Thank you to the people who stuck up for me on this and understand where i am coming from.

The hair dye itself in my eyes has ruined my bag, i know it is there. you are right maybe i should have taken more care, but i did even move the bag out of the way to the other chair that wasnt being used, but still dye was got on it. i have been having my hair done for ages and this has never happened.

They have taken it to be professionally cleaned but it hasnt removed the stain, it has took a bit of the colour of it out but there still remains a dark stain. Also with reference to putting a badge on it, that isnt somehing i would do. it would look more ridiculous, but thanks for the advice on that though.

The comment on red hair being chavvy, well i disagree, i may be bias but i genuinely dont think it is - but that is if you get it right. some reds look awful and faded, my infact is a deep red, i have to use a bright red dye to lift my dair roots - but if i am honest that is no way or form in relation to the post. my post was 'does anyone know my rights or where i stand' so wasnt really fair to have put that.

The bag itself is a discontinued design and type of bag, it is the Paul Smith violet, so i cant buy from the shop and i have not seen any second hand ones for a while. if i did, i would happily say if you brought me this i would be happy.

I had been advised, this is why hairdressers and others traders have the public liabilty for if these sort of accidents happen, i have never said it was done on purpose, it is more how it has been dealt with & being told i MUST get a solicitor to deal with it for me!

They have offered to re do my hair, but i have refused simply because if they got it wrong first time, they are highly likely too on the second one.

Again i must reiterate the bag i chose to buy myself , yes it was expensive, but i didnt choose for the hairdresser to get dye on it.

    Thanks Marianne x
