    If you wish to go the court on this. That is your legal right. But this has nothing to do with the card provider as they do not work under DSR. They have to work under the Visa/Mastercard/Amex regulations.

    The whole reason card providers will/do not action these is they know they will be rejected and the card holder redebited. It is simply not fair to do this.

    This is a bit contradictory because the companies T&Cs state that autorefill can be cancelled at any time by simply logging on etc. If we the customer have done that, informed them of that and taken proof of that and the company then goes in and changes it, contrary to their published statement that autorefill can be cancelled at any time, surely it becomes a case of fraud committed by them. They surely can not hold people to refill conditions if they clearly state that we have the right to cancel them at any time, and we then exercise that right.

    The 1st large payment is not a auto refill charge. It is the full cost of the trial item you paid P&P on.
    As per their t/c, if you are happy with it, then they charge you....

    We do, do non reciept chargeback on this, and for some reason the retailer does not seem to contest....
    Maybe its bacause they are scared to do so.

    I have also just written to Boots with full details (in as much as we have them) of DS marketing and their games, as this was where I found the link to the product. Under the Boots UK recommends banner. I am sure they will not want such scammers being associated with them.

  • I have just joined this forum to say thanks for the various advice re deadsea beauty kits. My offer came up at the end of a Boot's survey. It is written here by contributers that, if you cancel your payment card and a new one is issued the bank/credit card company will notify the scammer of your new details. I an reassured by my card issuer that this is untrue. The law precludes this from happening. So that is what I have done. I have also asked the company to send me a return label so I can post the stuff back. We shall have to see what happens.

    You (and your card issuer) are right.

    When you receive a new card and the old card is cancelled, the card issuer will not notify them of the changed details.

    But...

    When the 'scammer' tries to charge to the old card, that charge will effectively be passed to the customers account, even if the old account is 'closed' and a new account is setup.

    Also write to Boots. I really urge you to. There's a feedback form on their website. And make sure you get an email trail going to them stating you want nothing more to do with it. If you have to dispute the payment with the bank, it will help. And tell your bank to block all payments to any company by the names DSMARK*DEADSEASET, DS MARKETING, DEADSEASET.COM, DEADSEAKIT.COM (OR JUST DEADSEASET OR KIT). DEADSEAKIT*LONDON, DEADSEASET*LONDON or any variant thereof.

    Does anyone have any more variants of names these people use?

    Oh and Dalesrider here knows what he is on about from the perspective of the banks. Lots of very good advice in his posts.

    Hi - it was the actual company that refunded my money, not through the dispute as I e-mailed them and told them I would take them to the small claims court.
    I went on the company website and cancelled the top up fee as well, but I keep checking just in case ..........

    Oh dear...... Who passed this gem to you?

    While in part true. Your bank/card provider do not notify the companies.
    The retailer can get the new card number via on Visa cards. The Visa Account Updater.
    Retailers have access to this and can simply request the new card and update your details on their systems.

    Not sure what law is being refered to here, but as someone who has access to VAU as part of my job....
    Its here to stay as it is what is used to update companies with customers instructions to stop CPA's.....
    If only ALL companies were on it.
