after many emails this is the reply I got today...
    Dear Julie,

On 2013-02-01 at 14:24we received your order for a 2 week trial of our 3-stepDead Sea Beauty Kit, with retail value of over GBP 120.

By placing your order, you had to agree to the Terms and Conditions of ourrisk-free trial offer which state that you will have 2 weeks to evaluate ourproduct completely free of risk to you. If you are not fully satisfied at theend of the trial period, you can simply notify us and return the trial kit tous, without having to pay for it. The Terms and Conditions which you agreed onupon placing the order also state that if you do not notify us during the twoweeks, we would charge you the discounted cost of our Dead Sea Beauty Kit, i.e.GBP 97.95.

Please bear in mind that we have recorded your IP address and it matches yourspecified delivery address location. Furthermore, we have proof of delivery ofthe trial package to your address, which also matches your IP address.

What I can do for you is cancel any and all future AutoRefill deliveries andcharges. However, the charge of GBP 97.95 cannot be refunded unless you canprovide evidence that you have returned the item. This is a GBP 120 productthat you received as a risk-free trial for only a small S&H charge and welog all transaction data to protect ourselves from consumer fraud.

In the event you dispute the charge with your your bank, we will provide allthe above information to them, which could result in consumer fraudinvestigation towards you and could potentially affect your overall standingwith your credit card company (e.g. Visa, MasterCard, American Express, Discover,etc.).

I would like to point out that we work within all card associations rules andregulations.

    Kind regards,

    Rozalina

Put it down to experience. You ordered the product and didn't follow the T&Cs that you agreed to, so they are perfectly entitled to debit the money that you owe them.

As you said in your previous post

Yes I'm stupid, no,I didnt read the 'tiny print'.

In future is you see a "free trial" ask yourself 2 things and real all the small print -
    1. What's in it for them?
    2. What do they really want my credit card for?

My wife fell for this but we cancelled 1 hour later. Naturally they still sent the 'kit' and it arrived 1 day later! So was not sent from Israel, in fact it was sent from a company called TFS in Rugby I offered to send it back there or any other UK address. Of course they said this was not possible. My bank (1st direct) has been great, when the scammers took the £97 it was refunded the next day. I believe at a cost to Dead kit company of £20. I advise anyone to inform their bank of the scam and tell them to claim back any money taken. If your bank will not help, switch banks. As this is obviously a scam designed to rip customers off! We still have the 'kit' unopened and would gladly send it back, but they dont want it back as it is worthless junk!

Please see my previous note about the email address to send proof of postage .... My apologies it is Stephen@deadseakit.com or victoria@deadseakit.com not deadseaset.com...... I have just checked my emails sorry for the confusion and they will reply on those email addresses
  • To elyander

I tried emailing the address you posted (stephen@deadseaset.com) to show proof of postage - but - surprise surprise - the email was returned as being 'undeliverable'

    Any other suggestions?

    Sorry its stephen@deadseakit.com or victoria@deadseakit.com

  • Thanks elyander - I sent an email to the above address complaining that the product did not meet with hygiene standards and that any similar product retailing at '£150+' would have INSTRUCTIONS for use and also A LIST OF INGREDIENTS within the packaging - not to mention a FOIL SEAL over the jars of cream to ensure that they had not been tampered with. I have lodged a complaint with my bank and told Dead Sea to refund me. I am still waiting on their reply.

KB1 Can you give me the information for returning the Dead Sea Beauty Kit in this country please?
  • The same happened to me last December. I stupidly paid the trial price but then did argue it out and they refunded over half of what they had charged me and said they would cancel all auto refills. Yesterday I received another supply!!! Emailed and called them - surprise surprise they've had an upgrade to their system and supplies have gone out in error. Over the phone they told me they would refund everything back to me but asked me to please post the products back it would only cost £5. I then get a confirmation email offering me the products for a third of the price and that any postage has to be met by me!!! I've been in touch with my bank who are going to refund the charge straight away as I have proof that I cancelled the auto refill but they do have 60 days to claim the money again. I've had no reply from anyone again this afternoon at Dead Sea (I have three email addresses - support, Stephen and Jane).
  • I have fallen foul of this as well. I am normally ultra careful, but these guys were clever and redirected me from the sainsbury's site to a supposed survey on Sainsbury's with the offer of a free gift if I did the survey. I realised pretty quickly afterwards that this was not quite right, and tried to cancel my order but they didn't respond to after it had been dispatched. I've been through all sorts of pa lava this week trying to sort it. I've sent many emails, and have even sent the product to their ridiculous Israel address with a tracking number, which cost me 13 quid. As far as I can see I have followed all their terms and conditions to get out of the deal. I also logged on to their system and changed all my details and auto refill to none, though I am betting they have the details else where as well. I have also told my CC company to try and stop any more payments though have been told this might be difficult. I have also asked them, which I believe is my right under the data protection act, to delete my details from any databases they stored them in. Again I doubt this will happen. Interestingly, I got scammed by deep sea blue, not deep blue kit, but it's the same company, they obviously keep changing their names to try fool more people.

Deep sea kit had a complaint against them uphold at asa, complaint ruling Complaint Ref: A12-202609 (asa org uk Rulings Adjudications 2012 11 DS-Marketing-Ltd SHP_ADJ_202609.aspx) but by changing their name they have just started breaking all the same rules again. I recommend that anybody who falls for anything by this parent company DS-Marketing-Ltd make the complaint again to asa.org.uk and get screen shots to send in if you come across them again.

Since I have followed their terms and conditions I am hoping that I get no more issues off them, but I think this could be difficult.
