Aqua Reward Credit Card - 3% cashback up to £100/year

Do you know if section 75 would trump the statute of limitation of liability, I don't know and wondered if you'd looked into this?
All Section 75 essentially does is holds the credit provider jointly and severally liable for any claim. (in very simple terms)
If a claim is statute barred by time, it is statute barred by time no matter who you claim from. Money may/will still be owed, but collection cannot be enforced by legal means (and hence many debtors aware of the statute of limitations act would refuse to pay up)0 -

Let's say after 7 years one of my solar panels fails completely (they are meant to last 25 years) and for the sake of argument the installer and manufacturer are no longer in business. If the problem arises after 7 years or even if it was a latent fault that you become aware of after 7 years then that's when the clock starts ticking.
Is your understanding different? If a claim is statute barred by time, it is statute barred by time no matter who you claim from.
I've had one claim where Capitalone did payout where they said I wasn't covered by Section 75 (it was a strike).
I know there is no guarantee but with a choice between a company that has given me great service in the past and one who are completely dis-organised at even simple tasks then I know which I would choose.
I would be grateful if anyone can confirm the understanding of the statue bar.
I think the clock would start ticking from the date of a problem (or awareness of it) not the date of the install.
The help and advice I get on here is very much appreicated.0 -
I received a letter from Aqua today stating:Thank you for requesting to open a new aqua Reward account. Your balance has now been transferred and [bla bla bla]
This letter is dated 3rd March 2014. I assume you guys who are waiting for cheques may have them in the post as well if they sent all of these out together.0 -
Lisy loo - I'm not sure about this because I'm not sure if it's been considered before, there aren't many situations where this would come up.
The contract is formed at the point the works are completed which would suggest it would run from installation, it's normally six years but in the construction contracts I deal with it can be up to twelve years, six is normal though.
Anything over this would require the credit card provider be jointly and severally liable for the warranty that accompanies your purchase, as you say assuming you've gone through the contractor and supplier.
I think it's a moot point and could be argued either way, definitely worth having this available but I wouldn't be certain it would work.0 -
I agree entirely (and thanks).
It was definitely worth doing it even if the cover only extends to 6 years - which is still a long time.
I have taken all the sensible steps that I can think of to mitigate risk (credit card for section 75, insurance baked warranties, buying from reputable companies, legal insurance etc.) but I'm not going to worry myself to death over every possible scenario of what can go wrong.
All sorts of things could happen in 10, 15, 20 years.
We could move or even be dead - not a nice thought, but these things are really not under my control.
As others keep pointing out, it just doesn't pay to be a control freak about things you can't control.0 -
Ah I'm glad it's just me that hasn't had their cashback yet.
Decided just to leave it and wait and see.“I could see that, if not actually disgruntled, he was far from being gruntled.” - P.G. Wodehouse0 -
I continued with my card. They haven't eaten my cashback - just used the wrong rate for a few days, because they started the 0.5% earlier than they said they would.
I didn't call them. I sent them an online message from their account administration website. They always reply by letter to that one, so it takes a few days.
I contacted via their web site and will see what they say. Did they adjust your cashback to the correct rate? I have just checked my earlier statement when it was still 3% and now see that the amount they added on was nearer 2% over the total! Hmmm0 -

They credited me with £8.99 - which is a bit more than I calculated as missing.
Your average may be near 2%, but check out which transactions got 3% and which ones got 0.5%. Those near 19-21 January and after got 0.5%, with all the ones before that getting 3%.
What I told them is what everybody in this thread did: that I was under the impression that transactions will receive 0.5% from 22 onwards, but it appears that some transactions before then received 0.5% instead of 3% too, and I wanted that accounted for.0 -
Statement with credit balance arrived from Aqua today. No word on issuing refund.0
