I've been told that accepting a without prejudice offer is legally binding and I am not accepting any liability for the car at all, so if something did happen, they would now no longer have any legal route.

You've printed out all the correspondence, including the legal advice?

Should be. As long as it is a "full and final" settlement and they cash it then they shouldn't be able to come back at all.

    5t.

It's not a full and final settlement, it's a goodwill offer.

They accepted my offer today via email, and I'm arranging payment via special delivery so I get a signature.

I hope that it is a cheque that you are sending and that it is crossed and made payable to the buyer.

Isn't that just on the air con issue though?

Just wait until the magic tree falls off the interior mirror. Could get messy.

Earlier you said you wanted something in writing that you could use in court should there be more from the buyer after you paid them off this time.

So why do you want a "without prejudice" offer being accepted??

You sure you are getting proper legal advice? (From a solicitor)

No it's a without prejudice "that's all you are getting" offer

Make it payable to the Honda Dealership they're using :p

That'll wind them up if they really are pulling a fast one and plan to fit a scrapyard AC clutch themselves.

They will be back on a regular basis, you have just given them a free maintenance contract.

How is that if it a settlement without admission of liability?
