Sold a car, air con stopped working, buyer complaints
Comments

First off, I'm not well up on the SOGA etc so after reading through this thread I have a question for those who do know...
The car was described with air-con which worked at the time of the sale, only to fail later.
After inspection by a dealer XXX part was found to be faulty.
A statement from an independent specialist confirmed that said part cannot be "bodged" to effect a sale & that it either works or it doesn't.
On what grounds would the buyer start court action?
Agree totally. There only seemed to be doubt initially when the cause of the fault was unknown (and there was speculation that it could have been bodged)0 -

They could equally have a statement saying because the system was under/over gassed, the loading caused the thermal protection in the magnetic clutch to blow. Just answering you question.0 -

In this case it would seem they don't have the above statement & anyway..
Wouldn't the dealer have checked the overall condition of the air-con system before narrowing down the cause of the failure?
Surely if anyone goes into a dealer saying the air-con doesn't work, the first thing to check is the "gas"?Always try to be at least half the person your dog thinks you are!0 -

Don't ask me. I'm not the one second guessing the buyer. Just saying what my view on it would be. The report on here says what needs replacing, not why. edit - maybe worth checking why they fail, then you can make a more informed choice.0 -
I've offered him a sum now as a final, single, good will gesture, but with the caveat that I will not accept the liability for the fault or any future faults.0

You are mad. How much you offering?0
-
I won't say, but it's about 30-40% of the repair cost.0
