How do you define the owner? If the person that has handed over the cash is the same as who has signed the V5 isn't that proof enough that they are the legal owner?
Not if there may be a chance of seeing a judge to hand it back. Same with the keys, enabling the car to be stolen before the case wouldn't swing it with many judges either. So maybe reigning in the bravado would be helpful here, and assume that there may be a case coming up, and doing things legally is in order.0 -

The V5 merely shows the registered keeper. There may well be a court case to decide the owner
Correct, the V5 doesn't confirm ownership but...the buyer test drove it thoroughly, bought it, took it away, signed the reciept

If you are there, don't get into a brawl whatever you do. This person might not be playing with a full deck.
Also, whether you are there or not, I'd be tempted to move any other vehicles you have round the corner for a bit. You don't want someone causing damage just to be spiteful and why should you have to pay increased premiums if they do?

Yes, good point. Also worth pointing out that as well as not refunding, the OP would not store the car as its not their property, they would not insure it and could not guaratee its safety. The OP needs to put them off returning it by being firm and sticking to their guns0 -

First off, I'm not well up on the SOGA etc so after reading through this thread I have a question for those who do know...
The car was described with air-con which worked at the time of the sale, only to fail later.
After inspection by a dealer XXX part was found to be faulty.
A statement from an independent specialist confirmed that said part cannot be "bodged" to effect a sale & that it either works or it doesn't.
On what grounds would the buyer start court action?Always try to be at least half the person your dog thinks you are!0
