There have been previous posts about lenders who won't refund their Deeds Release fees. As I've said before, a Deeds Release fee is part of what the FSA define as the MEAF, and lenders MUST therefore consider it as part of their refund calculation process.
But if their Deeds Release Fee element has not changed between when you were offered the mortgage and when you paid the fee, you haven't been overcharged and aren't entitled to a refund in respect of that element of the MEAF.0 -
Anyone know how far back claims can go? Have changed mortgage 3 times in last 5 years, phoned Abbey today, they are sending a form for me to complete. Also phoned Halifax, they dealt with my claim over the phone, not via a form as in table, £50 now on its way to me! well happy0

Sorry if this is the wrong post for this question but im finding the MEAF claiming thing really confusing. Im looking for some information on claiming it back from Gmac-RFC for us, and from Prudential for my Mum - can any one offer any details?

I wrote to Abbey at the beginning of March to claim back the MEAF I was charged (£225 plus interest) in September 2005, using template letters, and initially got offered £130 (£225 less their claimed original £95).
However, being a hoarder of stuff I got out my original documents from 2003 and could find no reference whatsoever to a MEAF, so I challenged Abbey to provide evidence that they had a right to withold the £95 and also reiterated my claim for interest.
Abbey asked for a 4 week extension to investigate the matter (i.e. find their records!!) to which I agreed, being a reasonable sort of bloke, but I reminded them that interest would still continue to accrue until they completed their investigtion.
I then got a letter asking for a further extension of time, which I refused on the basis that they'd had 10 weeks, which should be sufficient and if they didn't respond by the deadline then I would start a claim. :mad:
A few days later I got a letter offering me the full £225 plus interest at a Bank of England Base Rate +1% (6.25%), which of course :rolleyes: was made as a "...gesture of goodwill..." and was "...in full and final settlement..." of my complaint.
I'd call that a result and it shows that you can get interest from Abbey, if you are persistent enough! :j

I was just on my way out, and the post man stopped my and asked me to sign for a recorded delivery item, it was from Platform funding, an old mortgage company I redeemed two years ago, I wrote to them stating that I believe that I was overcharged on my mortgage exit fee, I didn't have any documentation, but I thought it was worth a try.
I got a refund of £25 today, the mortgage offer agreement I signed stated £100 and I was charged £125.
So a big thank you to Martin yet again for his advice.0
