    Yes, you could certainly involve the owners of the car park as legally they are responsible for the actions of their agent.

    But one of the frustrating aspects is that people who fall victim to these scammers often do not want to face the struggle of giving them a good hiding in court, even though it would be pretty easy. People don't want to do court in the great majority of cases.

    So while the well-oiled machine that is a private parking firm rolls out no end of empty threats to try and press its bogus claims, the victims, with genuine claims, don't make them pay.

    Even though you’ve written and confirmed who the driver was, it doesn’t make their actions any less unlawful. It just means that instead of unlawfully harassing the registered keeper, they can now unlawfully harass the driver.

    They still can't actually do anything, for the same reason that a blackmailer couldn't sue their victim if they didn’t pay.

    You have done exactly the right thing to pave the way to get paid some compensation for this breach of the Equality Act 2010. You are protected by that legislation whether you have a Blue Badge or not because you have a longterm condition which affects your day-to-day activities.

    Here, this article explains that they are breaking the law and have been for years and getting away with it (as the article is a couple of years old, bear in mind that it's now the Equality Act 2010 which superceded the DDA):

    As already suggested I would write and tell the retail Head Office:



    'Official Complaint

    I am disabled under the terms of the Equality Act 2010 with xxxx condition which affects xxxx (add brief summary of your heart condition and how it can slow you down, if you want) so you cannot lawfully impose the same time restriction on my parking as other able-bodied customers have to adhere to. Yet your parking agent is harassing me and trying to make me pay a fake PCN for taking a few more minutes when shopping at your store in xxxxx town.

    It is perfectly and lawfully reasonable for me to take longer - and to park for longer - as a result of my long-term condition.

    If your parking agent's cameras are sending these claims to all your disabled customers who dare to take a little longer, like me, then you are regularly breaking the law without ANY thought being given towards any reasonable adjustments. Never mind the adverse effect on your trade!

    If you continue to pursue this 'ticket' then I will have no hesitation in taking the matter further, including suing you and your agent for harassment and breach of the Equality Act 2010. I enclose a copy of the woefully inadequate response I received from your untrained parking agents - which in itself is further harassment as there is no requirement for me to give any further information since I have clearly explained my disability.'

    The retailer may cancel it anyway, or if not, then you can sue for a tidy sum in compensation if the usual scary letters continue to arrive.

    The harassment is covered by The Protection from Harassment Act 1997.

    PPCs routinely quote incorrect legisitation in their letters, so I see no reason why you shouldn't quote the correct laws in yours. :)

    I went to Crown Wharf Walsall and the barriers have gone. Went shopping for just over an hour and half and realised when I got back i needed to pay and display. I purchased a 3 hour ticket for which from the time i arrived and then left, i had stayed for just under 2 hours. will i still get a ticket ??? if so do i ignore the letters ?

    OK, you did exactly the right thing, you made the full payment for your parking. If the ticket machine required you to input the registration then hopefully you will not get sent anything. If the car park is patrolled manually rather than with ANPR then once again if you hadn't had a ticket one will not arrive.

    Either way if you are sent a charge you can safely and with clear conscience ignore it. Just keep the ticket safe....

    Hi shelvox - You won't get a "ticket", but you may get an "invoice". (I wish I knew how to type in italics/bold/underline - I'd highlight the "ticket" and "invoice":D)

    When the Crown Wharf started charging for parking (it used to be free for the first hour) there were reports in the local freebie newspapers about people being "invoiced" even though they'd paid and displayed - AFAIK it's an ANPR car park, but you have to input your reg. number into the machine. Apparently there were some "teething" troubles with the machines, and inputting of reg. numbers. And of course, some people didn't realise that they'd started charging. So there were a flurry of invoices received by a good few perplexed motorists!

    Shelvox - give them FA's user name is a good instruction on what to do - give them FA! Ignore any invoice that may arrive, and ignore any other correspondence completely!
    Either way if you are sent a charge you can safely and with clear conscience ignore it. Just keep the ticket safe....
