Hello, today I have received Parking charge notice from parking eye. 2 months ago I was in UK and had a borrowed car from a car rental company. They gave my details to parking eye so they know who the driver was at that moment the car was caught on camera staying too long at parkplace (about 8 hours). I didnt know it is limited staying there, but they say there a sign on which clearly states limit for 2 hours of free parking. Do I have to worry about it? Im from Slovakia.
    Thanks

I take it your back home in slovakia now? basically you are safe to ignore it they will not chase you legally because frankly it would cost them a fortune to try and sue you when your a non-resident of the UK anyway.

The letter chain you can expect to receive is in this thread https://forums.moneysavingexpert.com/discussion/2329119

  • Im in Slovakia now. The car was from a car rental company - the gave to parking eye all my details. I have read a lot today about it. The point of ignoring is they have no idea who the driver was and they cant get to it. Here in my case they know who the driver was. So I m a little afraid if its not better to pay them.

Knowing who the driver was is immaterial. Under English Contract Law the remedy for breaching a private contract is the losses incurred. In your case the landowner has incurred no financial loss, so they cannot claim £60 or £90 or whatever they are looking for, they can claim £0.00 only (it was a free car park).

What's more, Parking Eye cannot legally claim this, only the landowner can, Parking Eye cannot claim this on their behalf.

Seriously, ignore this, nothing will ever come of it.

  • They sent it on 30.11.2012, it´s became today and payment had to be made by 28.11.2012?!?
If they gime to the court (we are in the EU unfortunately) wont I have to pay more later? Now is it 100 Pounds. they wait 1 year and it ´ll be 500 Pounds.

    No.

They cannot simply increase the charge over time.

Also, as I've explained, legally you don't owe them any money at all (forget where you are, even if you lived in the UK you'd still legally not owe them any money at all). This is a scam.

You owe the landowner the loss they suffered, which, in a free car park, is £0.00.

You owe Parking Eye even less.

They are trying to scare you into paying money that you don't legally owe them. Its a scam.

  • Not 500pounds, zero pounds because they will have given it up as a bad job and will have moved on to someone easier.

No it won't. This is NOT a real fine. Just ignore them. Even if you lived here we'd tell you 100% to ignore them now that they have your driver details (which was the right thing to do so you have played this perfectly).

The only thing to worry about is whether the car hire company are charging you for handling any letters. If they charged an admin fee to your card for dealing with this letter, then email the hire company and tell them that the parking company have your details as driver (which is good!!) and that the hire company can ignore any other letters that come their way as they have no liability. You can even demand the admin fee back because this was never their charge to handle and probably is not covered by their terms & conditions (t&cs).

Tell them that you are stopping the authority on your credit card because your business with the hire co is done and anything about this 'fake PCN' from a private company is not a real fine and so cannot be handled by the hire co - basically it's none of their business.

Then get on to your credit card company and tell them that any other requests for money from the hire company are to be refused as your authority has ended and the business with that firm under their t&cs is finished.

That is all you need to be concerned about - stopping the hire company from merrily charging you for handling each letter. Forget the scam parking company!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • before I came to the UK I was in my bank and asked for a credit card because I needed it for renting a car. After my return from the UK I went to my bank again and cancelled the credit card (because I dont it, I needed it only for car rent). So when car hire company sent me a letter with parking charge notice, there was a note: Parking fine received. Card declined. I guess they tried to take money from my credit card but at that time it didnt exist any more. So now they try getting their money direct from me.
I write it once again. I have read a lot today about it and all it is about - they dont know who the driver was. Because there is a photo of the car but not the driver. Here in my case they know exactly who was the driver. Car hire company sent them Rental agreement and all my details are there. This is why Im worring. Thank you all for your advices.

It does NOT matter that the PPC know you were driving - with a hire car situation, this was the right thing to do because it stops the hire firm from getting any other letters. This is just a mail scam, like phishing emails, and if they do send letters to you then just IGNORE THEM. It's OK!!

Fantastic news about the temporary card as well. You are completely safe. DO NOT pay the private parking firm (PPC for short, on this forum) and DO NOT pay the hire company.

I would email a response to the hire firm's note.

    Say:

'I have received a note saying that you are 'attaching a parking fine'. However you are mistaken, a private invoice like this fake 'ticket' is not a parking fine at all. It is NOT covered in your terms and conditions as it is not a penalty/fine and does not come from an Authority (Council or Police only, in the UK).

I am quite astonished that I am having to point this fact out to a UK hire company when I am in Slovakia. Stop taking this invoice seriously, it's a well-known scam and not a parking fine at all. I invite you to simply Google the company!

Now that the parking firm have my details then they can write to me if they wish - but it's not an issue for you at all, it's a contract allegation against ME not a penalty against the vehicle. They will not be able to write to you again and quite frankly you should have ignored it from the outset. I am amazed you took it so seriously when it isn't a parking fine - I guess it's an error by a staff member who doesn't know the difference.

I owe you nothing and I owe the parking firm nothing so please stop wasting your time over this matter and trying to pass it off as a 'parking fine'. You seem to have fallen for a scam but at least you didn't actually pay it which would have been even more ridiculous. Compliments of the season, from Slovakia!''

  • I didnt explain the whole situation. 2 months ago I was in the UK. 1 month ago I received a letter from car hire company with a parking charge notice. I called there and they told me to wait for a letter from PaRKING EYE. Today I´ve received a letter from parking eye - they know I was the driver and they want 100 pounds. I am taking it seriously because a) this is EU b) they have my details. If they give to a court I will have to pay more than 100 pounds I guess.
