Hi guys,
Like many here, I've an outstanding "invoice" from these scumbags and would rather burn in hell then pay them a single penny. After about 4 letters from them so far and I've now received a phone call asking for payment :rotfl:
I politely asked if they would take me to court if I didn't pay, to which the individual on the other end replied the may take legal steps. I then ended our delightfuly brief conversation by saying that I look forward from hearing from their legal department.;)
Anyone else had any calls from them 0845 6808741?

Following a letter from Parking Collection Services (which I ignored, naturally) I've received my first letter from Debt Recovery Plus.
The letter states among other things:
"We are a member of the British Parking Association (BPA) ..." and this also appears on their letterhead.
I find it curious that a debt recovery company should be a member of the "British Parking Association".
Just saying.

I have read numerous threads regarding Euro Car Parks and Debt Recovery Plus. However, all of them seem to be against individuals. Are the rules the same if the parking 'invoice' is issued to a company rather than a person?
We sent a dispute letter (against my advice) which was completely ignored and now we have a debt chasing letter from Debt Recovery Plus. I now don't know what to advise our accounts dept to do as it's the company name that is connected to it and not an individual.
I don't want it on my head if our company gets summoned to court!

I assume from the length of time this appears to have gone on, that the original incident happened prior to the 1st October?
Prior to this date, only the driver could possibly be liable for forming a contract by way of reading signs at a location. How on earth do they think your company could be legally liable for that??
How do they address the issue of liability in their letters? Your company can either ignore, or write back explaining that as they were never a party to any contract with anyone in regard to the car park in question, then they can never be held liable for any alleged debt in association with a breach in the said contract.
If you do write, why not ask in what capacity Euro Car Parks would be acting in the event of any legal action, and if not as a third party agent (which would be illegal) then can they supply evidence of their contractual arrangements in respect of the land? You would also like to see a breakdown of their or the landowner's costs in arriving at the figure they are asking for.
In the absence of such evidence they can go and screw themselves.Je Suis Cecil.0 -

As ManxRed said already, and here are some links which explain the position in that pre-October a fake PCN can only have been the business of the driver (who could then ignore it of course because it's a scam):

We would suggest the company as the registered keeper/owner, just plays snap with the threatograms from debt collectors - choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority.
Let them send the letters or alternatively you could write a really strong reply that either says 'get lost this is harassment, do not contact us again as clearly a company was not the driver and this is too long ago for records to be reliable'. Or a letter that politely says 'get lost and if you write again we will charge you at a rate of £50 per letter for handling this speculative invoicing. Only the driver can be addressed by your alleged charge and we will not name the driver unless you pay for a Court Order - and to respond to that we would charge another £100 for our time for responding, and substantial extra costs if you want us to attend a Court hearing. We suggest you address your letters to the driver, whose details would have been up to your company to identify at the time of the incident.' (or whatever sums you fancy saying!).
You have no reason or liability to name the driver for an incident prior to October(except if they get a Court Order which they won't). And you have no liability for the charge, full stop, so you can have a bit of fun with this.
P.S. Now though, for incidents from 1st October 2012 onwards, if you are in England/Wales, the new Protection of Freedoms Act means simply that you should name the driver (name and address) within 28 days and that then stops any comeback against the firm. Details here from the BVRLA (trade body for lease hire fleets but relevant for your info as well).
However this is not retrospective to incidents prior to 1st October - so as we have said, you do NOT have to name this driver for this old incident - nor pay of course!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

please help, i think i get the general idea from previous posts
but unsure of last post since 1st october?
received a parking charge notice today from euro car parks, for parking in a free car park for 15 mins, apparanlty in a disabled bay.
Car was parked in a white bay which did have a disabled badge on the floor, but there are 2 large yellow bays at the end with disabled badges in, didnt notice the white disbaled badge and just assumed the yellows were the only ones.
Registration number on ticket it incorrect, although make and colour are correct.
What should we do?0 -

They are all or have been suspended from accessing the DVLA database for gross misconduct!
