Well, it took a while, but here we are.
They took me to court for "£2,560", and yesterday, the judge quite correctly dismissed the case.
- No evidence of contract between Sainsburys and ECP
- No witness statement
- Nothing to show the claimant has the right to issue proceedings
- No proof of system of data collection, no evidence to show the cameras were working and that it's safe to rely on their evidence
- No proof of breach of contract
- No submission of of evidence of quantifiable losses, therefore their ludicrous "parking charge notices" are nothing more than unenforceable penalties
I cannot thank this forum and the Pepipoo one for everyone's support and chiming in. In particular I must thank Alexis, who has been a staunch ally in this, right up to the last. Also thanks to Matthew for his early advice.
You will be proud to hear that they even submitted a print off of my original enquiry here as part of their bundle, not entirely sure how it would help, but they are clearly daunted by the coaslescing of common sense to be found here.
So what can I pass on from the experience ?
Use your common sense.
Don't be intimidated by this kind of unregulated, these illegal demands for ludicrous sums of money. Ignore them. But then most of you knew that already.

I've moved this to the Parking sub-board0

My congratulations to you, what a fantastic result
just shows what these invoices are, a complete fabrication set up on lies and intimation.
Also well done Alexis !Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
Another one bites the dust.
Well done you n AlexisFor everthing else there's mastercard.
For clampers there's Barclaycard.0 -
That's pretty freakin sweet.
well done memphis73 and all those that helped.0 -
Congratulations! Don't bother passing my condolences to Euro Car Parks! They got what they deserve.0

a nice result, suggest you complain to Sainsburys about your ordeal at the hands of their agents, ECP.
Here is a fine example of an ECP sign, spotted just by a Sainsburys near Derby (A52)From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
is the use of the 'P' word enough to get them in trouble?0

@memphis73
This must have been something of a first for ECP and one would not be too surprised if they don't bother again for a while.
I trust that you have got hold of the local press and let them have the story? If not, do so as the word needs to be spread. Well done. There are many who, in the face of that amount, would have folded and tried to negotiate their way out of it and in so doing have effected as comprehensive an overturning of a PPC's case (next to Ibbotson) as I've yet seen.
@tospig
Yes. Get a complaint off to the DVLA - foi@dvla.gsi.gov.uk marking it for the attention of the Data Sharing Team. The sign photo should go to Martin Cutts but I'll have to dig out the email address as its on my phone and that died earlier. I'll re-edit the post when I find it.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
So, one of the biggest members of the BPA's AOS scheme, issues a court claim against someone who must have racked up 30+ fake "tickets", and their claim is laughed out of court as being without any merit whatsoever.
Yet the DVLA continues to release registered keeper data to these jokers.
And new people still come on here asking if they should "pay this fine".
Curiouser and curiouser.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
this is the email address I used when I sent a picture of a sign to Martin
