I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

The boss of Euro went on record a couple of years ago stating that "they've never taken anyone to court due to the shaky legal ground they're on". That belief has now been confirmed!

Famously the MD of ECP admitted a couple of years ago that they'd never taken anyone to court because they weren't sure of the legal status to their tickets.

Hopefully this has clarified things for them. :)
  • Thanks all. What would be most useful in terms of contributing some of what I've learned to the board ?

I'm not sure how much I can copy letters and data up here, but if it helps...
  • Thats a fantastic result - well done.

Well done! Would love to see the details of letters & data that we could quote to help others.

I recall your case from here and pepipoo I think. Was yours the case with several fake PCNs from various possible unidentified drivers and ECP issued a banning notice to you, the owner - and they also hounded your wife and child when they tried to go shopping using the same car?

Are you thinking of counter-suing now? After all, you were only the registered keeper and your wife was the person who happened to be driving the car on the day she was shouted at. Why would you or she deserve to be hauled over the coals like that by a big business (large) private parking company?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well done to yourself and Alexis.

Euro probably thought the £2.5K was worth the risk, I bet they wish they hadn't now?

    Did you apply for costs?

Time for a letter to Sainsburys with all the details as well me thinks.

Maybe they would like to comment on the behaviour and legal standing of the their PPC against what are in effect their customers.

Does anyone have sainsburys public relations department address?

Well done by the way Memphis :T:T

memphis and co. do indeed deserve congratulations on this well-deserved win.

but ECP doing court? happy to be corrected on this but: I was always under the impression that ECP never went near m'learned friends.
so why now? what made ECP change its 'shaky ground' view and take a punt?

I think I know the answer; I think ECP - along with all PPC's - got rattled by the (then) Freedom Bill. it got all sweaty-palmed and hot under the collar as it read through the proposals, coming on top of increasing paranoia caused by sites such as this. my God, how they must hate us!

so they had to take a stand. make the big statement. cut a dash. throw money at the memphis case and hope that justice beak would be as ill-informed as memphis would be unprepared.

    wrong and wrong again.

a win would have given them a renewed sense of confidence. a blaze of publicity would have followed, along with stern warnings about buying into the type of advice offered sites like this. and POFA would seem not so much a problem as a mild nuisance (IIRC, ECP never clamped). the cash would keep flowing in.

perhaps now, ECP has descended into a bunker mentality, with the directors telling each other that they 'would have got away with it, if it weren't for those pesky kids'.*

I could be totally wrong, though.
