    And a great one to reassure people that the fact we can no longer say 'I wasn't the driver' does not mean there aren't a good number of other lawful reasons why these fake PCNs are unenforceable when properly defended.

    I don't suppose there's a transcript or was it thrown out without a hearing?

  • It was a 45 minute hearing, case dismissed for many reasons. the judge suggested she could have dismissed it as they hadn';t even taken the time to file a statement of truth with their submission - I had a feeling she wanted to go through the process of giving it a hearing just to underline how inept their claim was.

    With regards the new Protection of Freedoms Act, they mentioned it, but of course this cannot be applied retrospectively.

    Nauseatingly, they said in their letter to the judge (as they were not present) that "our aim would have been that if Euro Car Parks were awarded the claim that the money will be forwarded to a charity of Sainsburys [sic] choice".

    Yeah, sure.

    Their will be a transcript available. I would love to be able to fund it myself, but am not able to but would happily chip in if others would be interested in having one made available for other cases/ further campaigning.

    I will receive the actual notice from the court early next week, but in the meantime the case was 2QT19160, heard on 9/10/12, at Wandsworth County Court.

    Any chance you might post up (here or on Pepipoo) a copy of that letter. What reason did they give for staying away?

    Although the CPR does contemplate that litigants might choose to have cases dealt with in their absence it does look rather cowardly, like they don't have the courage of their convictions.

    After one ppc wally was told to bring a toothbrush next time maybe didn't want to risk the chance of not getting home that night.
