So i send the second letter in which i threaten to take them to court? They haven't definitley said no the the reclaims, but i am just confused what i write and what new timescale i give them etc
Yes, stick to the timescales specified in the letters. Carry on with the process until you get the response you're after i.e. a full and unconditional refund.0 -
from my understanding u should have got the bank statements first.. otherwise where did u get the figure £2800 from???? they need a documentaction evidence of what charges and when etc
i could be wrong but im 99.9% sure u need evidence i.e bank statements... unless of course you have kept the last 6 yrs!!

as mentioned in my post " i never actually at any time asked for statements as i have everyone dating back to June 1996 "
thats how i was able to come up with the £2800 figure. i just checked the date on the letter they have sent me and its dated the 10th, but i only sent out my 3rd letter on the 12th so seems its either taken 5 days to get to me (likely) or they had there letter sat on the desk ready to go out once they received mine (more likely?)

Hi all,new guy here,after all the publicity for claiming back bank charges i decided to have a go,sent of my letter for all charges on my accounts,grand,,all well,sent off my letter requesting my 1500 pounds back,,,got a letter today telling me that complaint handling rules set by their regulator FINANCIAL SERVICES AUTHORITY,this allows them 8 weeks to investigate and respond....should i wait ,,,,or contact them demanding action now,,,cheers for any help info or guts ,,,andrew j hogarth,,scotland0

I have started to reclaim my bank charges and have sent necessary documents to bank. They have responded saying that they have received my complaint and that it could take upto 8 weeks for them to go through their complaints proceedure. Do I just wait until the 8 weeks are up and then continue or can we proceed now???

The advice almost everyone here will give is to go ahead with the second letter, so threaten court action.0

Hi,in my second letter asking they pay back my charges i put:
Furthermore if you fail to comply with this letter, I request without further notice a breakdown
and proof of all costs involved, in regards to your actual or liquidated losses involved in any
breach of contract to which these charges relate with yourselves, and that these charges
reflect your true costs in relation to the said charges, and are proportionate to the charges
levied on my account as defined in Unfair Terms in Consumer Contracts Regulations 1999.
Schedule 2 (e).
Therefore I require you to refund me a total of £1516.42,including 8% interest representing the total,unlawful amount charged during the last 5 years.
I hereby give you 14 days to refund the charges back on to my account. For the avoidance of
doubt, if this is not done within 14 days, I will commence my claim in the courts without further
warning. This action will inevitably involve you in additional costs
not sure if they just panning me off until april ,after the ruling on the charges is decided..not sure what to do ,,sit n twiddle thumbs ,,or go for the juggular,,cheers andrew j hogarth0 -

No, you stick to your timetable. This is a delaying tactic.
If they don't respond with a full and unconditional offer, you continue to the next stage.0 -

I finally got throught to hsbc tonight, apparently if you phone them before 5pm they have to stay there when they close at 5pm to answer all the calls that are still on hold.
Anyway, the stage i'm at is that i sent my lba letter and the 7 day deadline is now up. I phoned to see if there was anything happening with my claim before i go ahead and issue a court claim .
The woman just kept stating very parrot fashion that the "Financial Service Authority guidlines state that they have 8 weeks to reply.And i am about 4 weeks into it.and because they have been inundated thats why its taking so long....
So what do i do, just send the next letter??
