    Take all your charges documentation to the court as you will need the details to fill in your particulars of claim. At the local court they will help you fill in the form which is an N1 small claims form. Dont worry according to posts on the site here they deal with a lot of these and will help with anything you dont understand there and then. Good luck :)

    I'd give the bank a ring to find out what is happening as RBS seem to be paying out reasonably easily.

    I am currently reclaiming my charges from RBS and sent my letter asking for funds on the 9th of Feb, Since then I have heard nothing, I sent them a letter threatening court action on the 3rd of March and still didn't hear anything so I rang them yesterday.

    I explained that I am willing to start court proceding on the 19th of March as I have not heard anything from them and was told by RBS that they have 8 weeks :eek: from recieving my letter requesting funds which gives them untill the 10th of April.

    Is this right, do RBS really have 8 weeks from recieving my letter even though I gave them 14 days to respond then another 14 before I start court procedings??? :confused: I have been using Martins template letters.

    Any help would be most appreciated:D

    28 days in total is generally considered a 'reasonable' time to resolve before going to court.

    RBS seem to be going by the timescales in their grievance procedures literature and as with other banks seem to treat every claim as a complaint.

    You can ignore this and proceed, it's likely they are snowed under with claims and are trying to stall.

    Stick to your time scales not theirs. Just go ahead with the court procedure now and they'll have to reply...:D

    i bank with
    the royal bank of scotland

    i`ve had quite a lot of charges in the last 6 years!
    i currently have an overdraft facility £300 what is used constanly
    i also have a lone with the bank , (rough outstanding balance of £1,800)

    my only income is disability benifit now.

    so i`d like some help & advice on going about claiming charges back
    but i`am also a bit worried about them turning against me and closing the account , i can not open another account .

    would it be worth me going ahead with it.

    any help would be appreciated

    Im no expert,but i claimed and won and theyh didnt close my account,I oppened a step account with the nat west just in case,i would say claim,its your money theve have taken so get it back,it is very daunting at first,but thousands of people have reclaimed,if i can help just ask

    Do you think it's advisable to ring them before I start court proceedings and ask if they want to pay me off without having to incur court charges??

    You can if you like, but I would just file your claim if I were you.... if you are on benefits etc you may be exempt from court fees. Have a look at https://www.hmcs.gov.uk to find out the details.

    Plus once you have the claim in court you get the interest ;)

    I would ring them first having read the success stories about RBS.
