Thanks for the advice, lets go to court then!!!!!
Do you think it's advisable to ring them before I start court proceedings and ask if they want to pay me off without having to incur court charges??
Yes I would give them a quick call just to say you are taking the matter to court but you won't if they settle with you0 -
Hi ive sent my first letter asking for my charges back and my bank have sent me a reply. It states, thank you for contacting us and i am sorry that you have been so unhappy that you have felt you must complain. This pxxxxd me off considering its not the first time ive needed to compain but when ive gone to my local branch to talk to someone there is no one there willing to talk to you and they direct you over to the phones to talk to someone from a different country, STUPID OR WHAT!!
Anyway the letter also goes on to say that they are going to complete a thorough investigation and this could take up to four weeks. Now i know that they are trying to put me off from proceding but what i need to know from anyone out there is do i wait for the next few weeks or do i send the next letter threatening court proceedings (letter no 2)?
Im confused because they have said that they are looking into it but i know they are stalling for time, what to do please help?

Seems to be dragging for me this and what makes it worse is all you lucky people who are getting it settled quick! GRRRRRRRR
in post 311 it was mentioned about the Retail Regularatory Risk dept had written to the individual.
i had already sent off Template 1 (with interest) on the 14th Feb, with no response. then sent off Template 2 (with interest again) on the 28th Feb, again no response.
both of these letters were sent to my Branch up in Elgin.
i then sent off last week a formal complaint letter (found on a link via this site but cant remember exactly where) to the Royal Bank Head Office in St Andrews square stating that i wanted a resolution within 5 days.
This morning the Retail Regularatory Risk Dept have sent what would appear to be a template letter out to me stating that i need to send off £5 cheque in order to get my statements.... i never actually at any time asked for statements as i have everyone dating back to June 1996 (call me anal if you like!) and i used these to put together a spread sheet of charges which i enclosed with the 1st letter sent out on the 14th Feb!!
what is going on here? do i have to send a cheque for this and start the whole process again or is there something i can do?
am trying to get hold of my Branch to see if they are prepared to settle now for perhaps a lower amount (claiming £2800 including interest so would take £1800) to avoid court action.
feeling let down by RBS as they just seem to be stalling.

from my understanding u should have got the bank statements first.. otherwise where did u get the figure £2800 from???? they need a documentaction evidence of what charges and when etc
i could be wrong but im 99.9% sure u need evidence i.e bank statements... unless of course you have kept the last 6 yrs!!0 -

I'd say that the department is just churning out the same letters to everyone as a standard letter. RBS do seem to be settling fairly quickly but I don't think phoning your local branch will do much good as I doubt they will have the authority to refund you.
If there is a number on the letter you have received today I'd try phoning that one and point out your claim has already been sent in and what are they going to do about it.0 -

Yes exactly, continue with your timetable. You will be giving the bank adequate time to repsond. Don't let them delay you.0 -
So i send the second letter in which i threaten to take them to court? They haven't definitley said no the the reclaims, but i am just confused what i write and what new timescale i give them etc0

Roland, I have ahd the same letter back from the Halifax, and to be honest they are stalling until the OFT ruling so they can pay less. I have taken their "WE NEED 8 WEEKS" as a reason not to pay and have decided to just go to court and see how it goes. issued the papers today online, so will wait their response.0
