He will send the letter again, including the extra infromation. Should he update the date on his letter? As the cheque has been returned can he state that the 40 days are from them receiving his first DPA request or will it start from the date of his new request? I feel these are delaying tactics being used as I am quite sure that his initial details should have been adequate!

Bank letter has been sent from:

    Retail Regulatory Risk
    Business House B
    P O Box 1000
    Edinburgh
    EH12 1HQ

Should his reply be sent to this address or the St Andrew Square address?

    Can anyone advise please?
The 40 days are from when he first requested the information. This address is in the same building as the DPA address he should have sent his request to so just reply to this address.

Edited to add, if you read the recent Success Stories you'll find that RBS are paying out on the second letter :)

Hello, just wondering if someone could give me some advice. Im with the Royal Bank of Scotland, have a current account with them, have over the years had alot of bank charges, getting ready to sent off my first letter requesting my six years worth of bank statements, the question that I was wanting help with is I used to have a credit card with them and finished paying it off 2 years ago, did incur alot of charges when I had that account however I have got no idea what my account number is and have no statements. Do you think the bank will be able to give me this information. Thanks x:confused:

Ask them to trace the credit card in the letter you are sending now, that way it will only take the one £10 cheque.

I'll pop this into the RBS thread, have a read of other users' experiences and check out the recent Success Stories as I think you'll be pleased at the number of relatively quick RBS good results.

Cant believe how good this website is, only joined the forum about two weeks ago, already found myself an excellent mortgage broker and also have the confidence to send my bank a letter requesting bank charges back. Will keep you up to date on how I get on and thanks again for you advice. I see from reading back on this forum, you have been very helpful to other people on this forum.

Bank: Mint Credit Card - RBS
    Amount Claimed: £168
Amount Paid: £207.59 (including interest and court fee) :j

Sent first letter for statements on 11 December 2006. Received them on 4th January 2007.Sent letter requesting charges back for £168 on 8th January. Got reply on 24th Jan saying they were looking into it.
Got next letter on 1st February saying they did not accept the findings from the OFT regarding these charges and would not be paying back.
Sent the next letter threatening court and heard nothing from them so did my claim on MCOL.
Then got another letter saying they were looking into it again and it had been passed to another department.
Finally got a cheque for £207.59 on 23rd February :j

Just goes to show if you stick at it you will get there in the end :D
  • got a letter back from rbos customer relations today 5/3/07
usual rubish about fees being reasonable and transparent, was just getting ready to type my second letter when i turend over to page two
"as a gesture of goodwill and without admission of liability or error" yes you guessed it £4,360.00 the full amount being claimed, will be in my account in the next few days.
there was a PS which went along the lines that if i tried this again they may bounce me back to a "simple" account (no borrowing or anything else that could result in charges) shame they didn't do that six yearss ago when i was having a few problems!
Thank you moneysavingexpert you're my hero.
