hello, my husband had a RBoS gold account (current) he got into the overdraft then thinks went downhill, it ended up from a £500 overdraft to £2200 than the bank has passed onto debt collectors. This amount was built up by bank charges which they kept adding over unpaid direct debits ect, month after month.
I have told him about claiming the charges back and we are in the process of getting ready to post the first letter. My question is he has had letters from collectors offering 50% discount if he pays the remainder in full and more recently i think a new collector saying they now own the debt.
Can he still claim the charges back even after its supposidly been sold on as it seems?0 -
He can claim but... the debt collectors/bank may well expect to get any money claimed to cover the debt.0

hi edinburghlass, well we didnt expect to get anything back as in cash just really the charges to repay the whole of the debt to be honest (if he gets them returned) the other thing i didnt mention is the fact the account is now closed.
This mess has caused us some amount of hassle and we would be happy just to see the debt cleared, I know from looking at what statements we have here its charges of more than 2000.0 -
When you say RBS Gold account, I thought that was a savings account? If in fact its a Royalties account just remember you can't claim back the monthly charge for having a Royalties account.
You can still claim on a closed account.0 -
ok thanks edinburghlass, letter in post tommorow me thinks lol
ive been lurking on the forum for a few months and have found the advice given good0 -
Hiya,
I had £600 on my RBS Platinum Credit Card in November 2006. I have a platinum credit card cos they wrote to me and told me I was going to have one.
I made two payments in November of £100 - i.e. a total of £200.
On 1 December and 6 December I made another two payments of £100 =£200. In my mind, the payment I made on 6 December was to cover January 2007 - just to make sure that it was up to date given the Christmas/New Year forgetfullness.
On 16 January 2007, they charged me £12 as a late payment fee.
The woman I spoke to at their call centre, and the lady's supervisor both said they wouldn't give me a refund 'The Bank was not at fault' 'You should have paid the January payment after the 16 December.'
I'd like them to think out of the box for a minute, and look at what my account history has been. I don't want a late payment charge on my account.
I have raised a complaint via their on-line system.
I have been with the RBS since I was 15, some 24 years ago. They always seemed a good bank, I dunno, I'm wondering why they are still getting accolades for being the Number 1 in Customer Service.0 -

Why did you phone the bank? Most of the banks are sending out a standard letter saying they are looking into your complaint. Always do everything in writing unless its the bank who phone you with an offer.
Carry on with your timescale now.0 -
Called them because someone had said that this may get things sorted quicker... but will not contact them again will send other letter tomorrow. Thanks0

I'm after RBS for £400 of late fees on my credit card at the mo'. I found them a little slow in sending me the copy statements but I got them within the 40 days and have just sent my first letter requesting a refund (special delivery of course).
Reading this thread it looks RBS will be a pain but I'm determined as there's a principal at stake. A lot of those late charges resulted from me paying my bill IN CASH at an RBS branch BEFORE the due date, but because their "system" somehow takes 4 days to process this they charged me late fees. I protested a few of these at the time and got a "computer says no" brick wall response. I know full well they've had my payments in good time but probably had the money sitting in a magical netherworld earning interest or being invested, the swines!!! :mad:Bank charges reclaimed:
£2160 - First Direct
£415 plus court fee - HFC Credit card
£409 + costs + 8% interest RBS Credit card
PPI reclaimed:
£12541.82 from First Direct.0
