I had PPI on a credit card with A & L, this was taken over by MBNA, I have a claim with the Financial Ombudsman.
I cannot get a reply as to whether the years with MBNA will be compensated as well?
Anybody else claimed with A & L??0 -

I've had a eureka moment - I remember why I cancelled thanks to you saying about affording the payments! I got a new mortgage provider in 2004 and when looking at finances in 2007, realised I no longer had any connection with Northern Rock, so I stopped the DD with my bank. As my complaint in Jan 13 was based on the fact I thought it compulsory to get the NR mortgage. They say they will not consider the complaint as I was aware of misselling in 2007 and are trying to play the time barring card. Do you think the ombudsman will help in this instance?
The FOS may help. We dont have access to the files to see if you have a case. Your reasons are weak and statistically, most MPPI complaints are rejected (by both firms and the FOS).
The regulator sets the timebar rules. You have 6 years from the start date or three years from being reasonably aware of an issue to make a complaint. The 6 year one can rarely get activated but the 3 year one is the problem for you in this case.
Yours does not appear to be a mis-sale case but more a case that you continued to pay the premiums. If the NR MPPI did cover other mortgages, then you are on thin ice. The fact you changed lender would not be an issue in that case. Although if you bought MPPI again with the new lender or broker then you could perhaps look at dual insurance. If you didnt buy it with the new lender/broker, then it suggests you kept the existing policy and meant it to continue.I am an Independent Financial Adviser (IFA). You need to claim from Mbna for the time you had the card with them.0 -
Hi All, apologies if this has been answered elsewhere...
My husband answered a random call to a claims handler and decided to go along with them to make PPI claims. The company put him through to each on the lenders and it turns out he had PPI on several credit agreements. When he told me this, I told him he should have gone to the lenders directly so as not to pay the claims handling fee. I have now offered to try and do it all for him for the same fee they would have charged.
The company keep chasing him to fill in the forms and follow up the claims, but he hasn't done so yet. He says he hasn't signed anything. But if he had, would he be legally bound to continue with them, or could I just take over? Is he bound to them as they made phone calls for him (even thought he did the talking)?
Many thanks all.unless you've signed anything your not obligated, if nothing has been signed you owe the claims company sharks nothing, make sure you keep it that way, keep your husband away from the mail and phone lol.:)
Dear All,
Just to let you know, I filled in the forms - 6 in total and sent them off.
All have responded and said they are looking into my claim.
Northern Rock are the first to cough up and I am ecstatic to say that they have agreed to pay out almost £11,000! :j
I will let you know how I get on with the other 5...
ps, the claims co. have also stopped calling my husband0 -

The complaint I submitted to NRAM last year was because I believed it was a compulsory condition of the mortgage application with NR in 2002 to be approved (which I now understand was wrong.) Our income dropped a bit in 2007 when my hours were reduced to 30pw, so stopped the DD when trying to reduce outgoings. I thought since we no longer had any connection with NR, it was an unnecessary bill. I have no idea if it would have covered a mortgage with a new lender. Do I need to find out? I didn't take any new mppi, as we did't have it pushed on us.0 -
Hi new to this so bear with me please. I had two loans over 10 years ago and one credit which was paid off by one of the loans, almost positive I was misold ppi. However I now don't bank with HSBC and have no idea of the account number etc How do I find out if the details I need to find out if I was misold? I am put off by claims handlers but would it be a good ides as it was a long time ago?0

MBNA have done nothing wrong. They have simply taken over administration of the account from a company alleged to have Mis-sold PPI. If the complaint against A&L is upheld they should compensate the OP for all the PPI paid, whether its to them or MBNA. The only exception would be if MBNA agreed to take reaponsibility for A&L's liabilities when they took over the account.0 -

Firstly if you think you were Mis-sold the product then you don't need account numbers. Just give the product details, approximate date and the reasons you think it was Missold and ask that they check their records for further details.
CMCs can't do anything you can't. All they will do is ask you to fill in the same form you would anyway, send it in with a covering letter full of lies (which the bank will disregard as such) and demand a cut of any monies you are awarded.0 -
I have had my claim upheld by barclaycard.
When I first put in the form, they replied saying they couldn't find an account for me. I checked on Noddle and found that it still had an account and they were marking it green every month. I phoned them and told them this and miraculously my account details were found.
Now as far as I was aware the account was closed after I got into some financial difficulty and agreed to a repayment plan with them, now this would have been in 2004/2005.
They then said that they would have to carry out a credit reference on me because I had changed my name since taking out the card in 1995 (got married).
This obviously was ok because I received an offer of 6.00 from them last week.
Now I know that I paid a lot of PPI during 1995 - 2005, but of course haven't paid any since because as far as I was aware I no longer had the account.
Spoken to them and they have told me that this is their offer, but did tell me that I had ppi from 1995 - 2014. They could also see that I had had a payment plan, but they couldn't see the value of this.
I have also got to send them a copy of my marriage cert to get the payment even though they have confirmed through credit reference I am who I say I am.
I don't think I have any paperwork relating to the account although I do know that the balance when the payment plan was put in place was £1500.
What should I do next ?? Or do I just give up ??0
