    If I applied by post - was the box pre ticked? If it was, do I have a case?
    How could it be pre-ticked on a paper application form? That really would be a case of telling you (wrongly) you had to have it.
    Only pre-ticked internet applications were judged unfair, since the optionality of the insurance was not clear. This is not the case with postal applications-if you ticked the box you were actively selecting PPI of your own volition, no one mis-sold it to you.

    In your initial post, you say you've already made a complaint and are awaiting the result of their investigation. You make it sound like you've made no actual complaint and are just hoping the Bank will find some mis-selling reasons for you.

    I don't expect the Bank to find in your favour if this is the case...

    What I would like to know is how the application was made in the first place, as mentioned I cannot remember if it was done over the phone or via post.

    Sorry for not being clear, the initial contact I had with them involved no conversation about how the PPI was sold, I was told when the policy was opened and that someone would be in touch.

    Then I received the letters that I outlined in the original post, the last one came with form for me to fill out. What I am trying to find out is whether I filled in a form by post or spoke to someone do I have any case with the full pay from employer (company now changed name and owners) making the PPI not suitable or the fact I was not told there was alternative suppliers of the PPI. I was sure that the PPI could only be taken out with MBNA but since reading the forum etc realised that is not true.

    I think you need to read up on how to make a PPI complaint and what reasons are valid.
    Not being able to remember anything severely weakens your case.

    I was not told there was alternative suppliers of the PPI.
    They were under no obligation to do this. Tesco don't tell you that you can also buy in Asda, so why would sellers of insurance be any different?

    You'll just have to be patient and wait for the Bank to respond to your complaint before we can offer any useful advice.

    If the Bank continues to be tardy, you have the right to refer your complaint to the Ombudsman-but as this process takes in excess of eighteen months, I'd wait a little longer if I were you.

    Indeed. They are wrong about one thing though, the six months doesn't start ticking until they actually issue a final response.

    As per the previous comments they don't have to tell you that you can find the product elsewhere. Plus, with credit cards this isn't really the case anyway because the premium fluctuates with the card balance. So no other insurer will offer a policy to cover your MBNA credit card because they would not know how much to charge for it each month.
  • Just be truthful and say you don't remember.

    Do you think I should just reply only that I don't recall? Just concerned that they won't believe me.

    It's always best to be truthful, it means less chance of contradicting yourself and so weakening your complaint.
    The information required currently has little to do with your actual complaint, but you could link to it by saying you cancelled because you felt it didn't suit your needs.

  • Back in 2007, I didn't understand the whole misselling issue and only decided to pursue the matter just over a year ago. The chap at NRAM, twisted my replies to make out I WAS aware - when I said we may have possibly been involved with a remortgage. Since we have been with The same provider since 2004, it's quite obvious that wasn't the reason anyway. The Ombudsman want to know why I cancelled and I feel a bit daft saying I can't remember!
  • I still hold credit cards with a lender i am thinking of complaining to. If i do can/will they blacklist me around future credit, or cancel my account? Can anyone help me with this please? - the lender is MBNA - Thanks

    Win or lose, a PPI complaint should make no difference to your relationship with the Bank.
